While this systemic racism may begin with discriminatory police practices, it continues throughout the judicial system in the discriminatory bail policies (including money bail), implicit bias in charging and negotiation positions, the prosecution of "gangs" comprising people of color, disproportionate sentences for defendants of color, the over-emphasis of "criminal histories," which are themselves the product of years of over-policing of minority communities, and the under-representation of people of color on our juries.
