Accordingly, there have been a number of important developments over the last twenty years to encourage private enforcement of competition law in the EU and more specifically in the UK, and we are in the midst of a raft of initiatives at EU and UK level in this area. In June 2013, the Commission published a Communication and Recommendation on Collective Redress. At the same time the Commission also proposed a Draft Directive to harmonise aspects of private litigation across the EU. Furthermore, in the UK in 2013, the Government department, BIS, recommended the introduction of provision to allow cases to be transferred from the civil courts to the CAT, the extension of the competence of the CAT to stand-alone actions and beyond only damages actions to allow it to grant injunctions, and the adoption of an opt-out representative action for consumers and businesses (in follow-on and stand-alone claims).
