Andrea L. Hinshaw

Andrea L. Hinshaw focuses on estate planning, probate and estate administration, residential real estate transactions, and business law. She handles a variety of wills and trusts issues. In addition she represents Executors and Administrators in probate and estate administration matters. Andrea also represents small businesses in their formation and everyday needs.

Dan Higgins

Dan Higgins is a founding member of Burns, Day & Presnell, P.A with over 34 years of experience. Dan focuses on representing businesses and public utility companies involved in the telecommunications, water, sewer, power and renewable energy industries. This representation includes regular appearances and practice before the North Carolina Utilities Commission, the North Carolina Rural Electrification Authority, and occasional involvement in matters before the Federal Communications Commission and the Federal Energy Regulatory Commission. Dan provides Burns, Day & Presnell's clients with seasoned business and regulatory advice and insights on a broad variety of subjects. He has significant experience in negotiating and arbitrating interconnection agreements for telecommunications clients and he has tried fully contested regulatory and rate cases before the North Carolina Utilities Commission (most recently a water and sewer rate case tried in 2011). He has also counseled various utility clients on a host of regulatory, marketing and legislative issues. Dan handles commercial litigation for the firm's utility clients, as well as construction and lien litigation for other firm clients. Dan and his wife, Susan have two children. In his free time, Dan enjoys hiking and he is an avid cyclist. Dan recently traveled with his family to hike the Grand Canyon. Emily Iverson

Emily represents individuals, businesses, and banks in a wide variety of commercial transactions, including real estate, mergers and acquisitions, financing, and other business matters. Emily has structured, negotiated, and documented senior debt financing arrangements of all types, including secured and unsecured single bank and syndicated credit agreements, multicurrency financing facilities, asset-based lending transactions, and leveraged acquisition financings, for national financial institutions. In addition, Emily spent six months on secondment to the legal department of Bank of America, N.A. with the leveraged finance group. Practice Areas: Business and Banking Emily brings big firm experience to representing clients in a wide variety of real estate, business, financing and other transactions. She regularly advises individuals, businesses and banks in structuring and negotiating credit agreements, financing facilities, business acquisitions and other complex deals throughout North Carolina.

Greg Hinshaw

Greg Hinshaw is a founding member of Burns, Day & Presnell, P.A. He focuses on the acquisition, development, and disposition of property, business formations and transactions, and estate planning issues. Greg has more than 40 years of experience working with people and companies in their real estate, business, and estate planning needs. Greg has represented clients in mixed use and planned unit developments, office and shopping center financing and residential closings. In the estate planning area of his practice, he handles a variety of Wills, Trusts, Estates and Wealth Transfer issues. Greg also represents small businesses in their formation, acquisitions and mergers, and day-to-day legal needs. Practice Areas: Real Estate Greg is a founding member of the firm and has been practicing law in North Carolina since 1975. Today, he focuses his practice in the areas of estate planning, real estate transactions, and small business counseling.

Jay Mills

Jay is a litigator. He focuses his practice on two areas of the law: (1) serious personal injury claims; and (2) estate dispute claims. Jay has represented victims and their families in wrongful death claims, automobile accident claims, product liability claims, medical malpractice claims, and a host of other serious personal injury cases. He has served as lead counsel for numerous six and seven figure settlements and verdicts, attaining a favorable result for his clients. In 2014, Jay was lead counsel for a family member who challenged a will - resulting in one of the 25 largest reported verdicts or settlements in the State, according to North Carolina Lawyers' Weekly. Jay began his legal career in Atlanta, Georgia with Troutman Sanders LLP - one of the largest law firms in the country. As an attorney with Troutman Sanders LLP, Jay represented several large corporations, including Georgia Power, Wachovia Bank, CNN, and Carmike Cinemas. He also represented a number of individual clients, largely on a pro-bono basis, and was recognized by Troutman Sanders for excellence in pro-bono advocacy numerous times. Jay has taken several cases to jury trial, and handles all aspects of litigation. He handles some claims on a contingency-fee basis and other claims on an hourly basis or flat fee arrangement. Jay works with each of his clients at the outset to ensure that an appropriate fee arrangement is agreed upon and followed for each file. Jay has two children with his wife, Holly. In his free time, Jay enjoys playing golf and fishing. Julia Young Kirkpatrick

Julia Kirkpatrick focuses on construction and contract law, employment law and commercial litigation. She has extensive experience in a range of legal matters affecting construction, from contract review to pursuit and defense of bond and lien claims. She regularly advises general contractors, engineers, subcontractors and suppliers to prevent litigation, but is equally prepared to handle litigation. Her experience also includes advising employers regarding sensitive personnel matters affecting their business operations, and involvement in commercial leasing matters. Julia is an active member of the American, North Carolina, and Wake County Bar Associations and the State Bar of North Carolina. She has served as a member of the Wake County Bar Public Service Committee as chair for the This is the Law Hispanic/Latino legal education project, was a 2003 recipient of the President's Award of Excellence, and acted as Co-chair for the NCBA Young Lawyers Division Peer Mediation Task Force, as well as a Division Director for the NCBA YLD. She was recognized by the North Carolina Bar Association as its lawyer of the quarter in March 2005. An active member of our community, she serves regularly as a volunteer lawyer to the lawyer on the line program, is a member of the Board of Directors for the Carolina Youth Ballet and has held a variety of team leadership roles in the Junior League of Raleigh, including co-leading the 2007-08 Team of the Year. Kendra K. Bader

Kendra advises clients in the area of business law, representing businesses and individuals in a variety of commercial transactions including mergers and acquisitions, succession planning, shareholder relationships, statutory compliance, drafting and reviewing leases and other agreements, and other general business matters. Kendra returned to North Carolina after practicing in Minnesota for the first decade of her career. During her time out of state, Kendra gained a diverse background while practicing in both the litigation and transactional fields at several law firms ranging in size from boutique to national. Since returning to the Tar Heel state, Kendra has also spent seven months on secondment with the legal department of CAPTRUST, a national investment advisory firm.

Lacy Presnell

Lacy Presnell has extensive civil trial and appellate experience in a broad range of complex cases. He has represented individuals and businesses in state and federal courts in North Carolina for more than 35 years and has been lead counsel in business and estate cases as well as serious injury and death claims. His trial experience includes more than 70 cases tried to a verdict. Before law school, Lacy worked with U.S. Senator Sam J. Ervin as an assistant investigator for the U.S. Senate Select Committee on Presidential Campaign Activities (Senate Watergate Committee). He served as General Counsel of the North Carolina Department of Environment and Natural Resources in 2013 and 2014. He has served as a court-appointed mediator to assist others in settling cases for more than 15 years.
