While Medi-Cal eligibility with respect to long-term care was not difficult in the past, there has been a steady drift towards more complex and restrictive rules, the latest being the Deficit Reduction Act of 2005 which went into effect in most states in 2006. These changes have been approved by the California State Legislature and the governor. The state is in the process of implementing the changes within the Medi-Cal offices to implement the new law. This new law will require complex eligibility requirements for those in need of Medi-Cal benefits. It's will no longer be as easy as reviewing one's bank statements. There are a myriad of regulations involving look-back periods, income caps, transfer penalties and waiting periods to plan around. We are planning now to help our clients when this new law is implemented to the fullest.
