Michael Dew - CEO

Michael Dew's practice is focused on commercial litigation, particularly construction law, creditors' remedies, insurance matters, and shareholder disputes. Michael has worked on a wide range of construction law matters including disputes over work quality and entitlement to payment, as well as structural failure cases where he draws on his prior experience as a structural engineer to better understand the issues and serve his clients. Cases involving technical engineering issues have included retaining wall and embankment failures, ground settlement (under warehouses, and major residential projects), and structural failures (buildings and transmission lines). The builders lien cases Michael handles in the construction law context overlap with the general creditors remedies work he does, including foreclosures, creditors remedies in the bankruptcy context, and involvement with Mareva injunctions (asset freeze orders) and Anton Piller Orders (civil search orders). Prior to joining JML in 2011, Michael clerked for six justices of the British Columbia Supreme Court, completed an internship with the Provincial Crown, articled and then worked as an associate at a national law firm, and then worked as an insurance defence lawyer for two years. Litigation, and construction litigation in particular, often involves large volumes of documents and managing data effectively is important not only to ensure cost effective delivery of legal services, but is also an opportunity to obtain a strategic advantage and achieve a better overall result through superior understanding of the facts and management of the data. Michael is enthusiastic about using technology to improve the quality of legal services provided, and a strong believer that while competent use of computers is not a substitute for traditional legal skills (such as knowledge of substantive and procedural law, business judgment, legal writing skills, legal research capabilities, etc.), technology skills are now an essential additional area of competence required in order to meet reasonable client expectations. Michael strives to involve clients (who at the outset know more than anyone about their own disputes) heavily in the fact organization process, and seeks to collaborate with clients online using cloud technologies and familiar applications such as Microsoft Excel. As a relic of his engineering background Michael maintains a hobby interest in computer programming (primarily VBA) and builds spreadsheets to run his practice and client files more efficiently. As chief operating officer and member of the management committee, Sandra Lowe is responsible for day-to-day operations and oversight of JML's finance, human resources, information technology, marketing, and business development functions. She supports the firm's partners directly through stewardship of the strategic planning process and implementation of policies and activities to achieve their key goals. Greatly invested in community and international service, Sandra is a current board member of the Rotary Club of Vancouver. As a current director of HHART, she has helped plan and lead humanitarian trips to the Dominican Republic for over ten years. In 2020, she joined global nonprofit speaker series Tenant Talks as a guest panelist on "The Future of Law Firms in a Post Pandemic World." In her time as an ice hockey referee for Hockey Canada, she refereed games in Canada, Switzerland, and China. She now acts as a coach and mentor to those selected for both the BC Hockey and Hockey Canada High Performance Officiating Program. During the NHL season, she works as a video replay official or penalty timekeeper. Beyond the arena, she is an avid road cyclist and ride ambassador for recreational riding clubs.

Stephanie John is a construction lawyer with a background in civil engineering and project management. She has assisted clients at various stages of construction disputes, including the early demand and builders lien phases, through to litigation, including mediation, trial, and arbitration. Stephanie regularly assists in settlement negotiations, and has also appeared in chambers, before the Registrar, as lead counsel at trial in the British Columbia Provincial Court, as co-counsel at a private arbitration hearing, and as co-counsel at trial in the British Columbia Supreme Court. Stephanie's engineering background, clear communication style, and dedication to understanding the story behind each file make her a strong advocate for her clients. A significant part of Stephanie's practice is contract drafting, including drafting supplementary conditions, as well as custom contract arrangements. The Honourable Robert Jenkins

Bob Jenkins was a founding partner of JML and has returned to the firm after having served as Justice of the Supreme Court of British Columbia for over 10 years. Upon returning to JML, Bob will be limiting his services to acting as a mediator, arbitrator, referee or other forms of third party dispute resolution with emphasis in the construction industry and other commercial disputes. Prior to his appointment to the Court, Bob practiced extensively in the field of construction law which included acting as a Court appointed special referee, arbitrator and as a mediator on multiple occasions, often involving complex multi-party disputes arising from large commercial, infrastructure, transportation and resource projects. He was certified as a mediator and arbitrator by the American Arbitration Association and the Vancouver International Arbitration Centre, formerly known as the British Columbia International Commercial Arbitration Centre. He was also a member of the Arbitration and Mediation Committee of the Canadian College of Construction Lawyers in which he was a founding Fellow in 1998 and served several years on the Board. In his practice prior to his appointment to the Court, Bob was successful counsel in many cases before the Courts of British Columbia and in arbitration including: Representing trade contractors in an action for negligent misrepresentation as to the availability of construction financing against a chartered bank in the Supreme Court of B.C., the Court of Appeal and in which leave to the Supreme Court of Canada was dismissed: Micron Construction v. Hongkong Bank of Canada. Acting for a large electrical contractor involved in a dispute with a large international airport over a contract involving runway lighting which involved claims of almost $3 million. Representing an international general contractor in a multi-party claim over the construction of a hydro electric facility which was settled after mediation and involved claims exceeding $30 million. Representing a major general contractor for payment of over $3 million in damages caused by delays, breach of contract and negligence on the part of the consultants in a design-build contract for the design and construction of a large professional sports arena. Over many year of his legal practice, Bob coordinated and presented at multiple Continuing Legal Education of B.C. courses including the conduct of complex commercial litigation, arbitration and mediation. As well, he was a regular and prominent speaker on construction disputes for many construction associations including the Vancouver Regional Construction Association, the Independent Contractor and Businesses Association, the B.C. Roadbuilders and Heavy Contractors Association, the British Columbia Construction Association and other regional construction associations.
