Tree Liability in the South has been established in response to the growing demand for arboricultural reports relating to public liability and subsidence in particular. Our aim is to simplify the focus on data collection, analytic reports and mapping of trees, much of which in our opinion, is unnecessary in situations where a landowner acknowledges the fact that the trees on his/her property may be a risk to the public and as a response contracts an arboriculturalist. Costs are an issue and tree survey costs add to an overstretched budget. We aim to approach tree health surveys from a legal stance, that of seeking to focus on the landowner as a defendant seeking to mitigate the steps taken to acknowledge what is known in law as a ‘duty of care'.
