11.2 Except to the extent set out in clause 11.3, nothing in the Agreement excludes, restricts or modifies application of the statutory conditions and warranties under the Competition and Consumer Act 2010 (Cth) or other non-excludable conditions or warranties... 11.3 The liability of Lantrak in relation to provision or performance of the Services is limited to supplying the Services again or paying of the cost of having the Services supplied again... 13.3 If Lantrak is unable to provide the Services due to circumstances beyond its reasonable control (including condition changes to the Authorisation, Environmental Law or any other laws) then Lantrak may suspend or terminate that portion of the Services by written notice to the Customer. Time is not of the essence in relation to performance of the Services.
