This POA operates the same way as a Home Owner's Association does, and is governed by an elected board of directors. Because the subdivision is responsible for it's own water and roads, it acts as a municipality, and is required to follow and enforce the restricted covenants and bylaws drafted and approved by the owners of the subdivision. In addition, New Mexico has passed legislature that dictates how HOAs and owners should legally conduct themselves.
