Alex M. Brill

Mr. Alex Brill has a broad range of public policy expertise and experience including tax, pension, trade, budget and health policy matters. Mr. Brill formerly served as the Policy Director and Chief Economist to the House Committee on Ways and Means and oversaw a broad portfolio of legislative matters in addition to assisting then Chairman Bill Thomas (R-CA) with negotiations with House and Senate leadership offices as well as Senate Finance Committee members. Prior to his tenure at the Ways and Means Committee, Mr. Brill was an economist at the White House Council of Economic Advisers (CEA), where he provided advice and analyses on national and international economic policies for the President. In 2010, Mr. Brill served as a consultant advisor to the President's Fiscal Commission (Bowles-Simpson Commission). He also currently serves as a research fellow at the American Enterprise Institute. Mr. Brill's health policy focus includes reimbursement matters related to the physician fee schedule, the FDA drug approval process, biosimilars, and Medicare Part B pricing. Mr. Brill's health policy research includes an investigation of overspending on multi-source drugs in Medicaid, optimal exclusivity policy for biologics drugs, and the consequences of certain taxes and fees within the Affordable Care Act. He has served as an expert witness in a number of patent litigation cases, testified before Congress on numerous occasions including before the House Committee on Judiciary regarding biologics and regularly appears in the media to discuss the economy and pending federal legislation. Mr. Brill is the Economic Policy Advisor of Hooper, Lundy & Bookman's Government Relations and Public Policy department. He has a B.A. in Economics from Tufts University and an M.A. in Mathematical Finance from Boston University.

Alicia Macklin

Alicia Macklin is a partner in the Los Angeles office and serves as the co-chair of the firm's Health Equity Task Force. She regularly advises behavioral health and substance use disorder treatment providers on a broad range of legal and compliance issues, including Federal and California privacy and confidentiality requirements, Medicare and Medi-Cal reimbursement, county mental health plan contracting, and involuntary civil commitment under the LPS Act (Lanterman-Petris-Short Act). Arthur E. Peabody

Arthur E. Peabody, Jr. focuses his practice on Medicare payment and reimbursement for hospitals and other providers. Arthur brings a unique perspective to Medicare reimbursement as a result of his knowledge of the Medicare cost reporting and reimbursement, understanding of both provider and government interests, and his skills as a trial lawyer - a rare combination. He has substantial experience is all aspects of the Medicare reimbursement process, from the preparation of cost reports to the litigation of appeals. Arthur has over 15 years of experience litigating Medicare cost report appeals before the Provider Reimbursement Review Board (PRRB), representing both providers and Medicare Administrative Contractors (MACs). In these capacities, he addressed most of legal issues in the Medicare reimbursement arena, resolved numerous cases resulting in the payment of millions of dollars to providers, and gained the ability to evaluate Medicare reimbursement issues from the perspective of providers, MACs, and the government. Arthur assist hospitals in developing effective strategies to ensure providers obtain all the Medicare reimbursement to which they are entitled. Previously, he served as an Assistant United States Attorney for the Eastern District of Virginia (Alexandria) and as a member of the Senior Executive Service in the Justice Department where he held high level executive positions in the Civil Rights Division. As an Assistant United States Attorney, Arthur handled a broad array of complex civil litigation in federal court proceedings representing federal government agencies. He also initiated affirmative litigation and supervised investigations, including health care fraud actions brought under the False Claims Act and other federal regulatory provisions. In the Civil Rights Division of the Justice Department, Arthur served for many years as the Chief of the Special Litigation Section where he led the nationwide federal enforcement program for persons with disabilities, institutionalized persons, and other persons in need. In this capacity, he traveled to 46 states and appeared in 34 different federal district courts , and negotiated settlements with Governors and State Attorneys General. David P. Henninger

David P. Henninger has practiced health care law since 1986 and he served as Chair of Hooper, Lundy & Bookman's Transactional Business Practice Group for six years. Mr. Henninger represents private and public hospitals, physicians and medical groups, diagnostic centers, ambulatory surgery centers, pharmacies, medical equipment companies and other health care entities in all types of business transactions, including the purchase and sale of facilities, the preparation of private offering documents, the structuring of joint ventures, and contract negotiations. He particularly specializes in advising clients regarding a wide variety of regulatory issues, including anti-kickback and physician self- referral laws, antitrust law, public and private reimbursement, licensing and certification issues, and regulatory compliance programs. David S. Schumacher

David Schumacher is a partner in Hooper, Lundy & Bookman's Boston Office. He focuses his practice on criminal defense, fraud & abuse compliance and defense, as well as other health care enforcement actions. He is co-chair of the firm's Fraud & Abuse Practice Group. Mr. Schumacher was previously deputy chief of the Health Care Fraud Unit in the U.S. Attorney's Office for the District of Massachusetts. During his eight-year tenure as a federal prosecutor, Mr. Schumacher investigated some of the largest and most complicated health care fraud cases in the country. Mr. Schumacher investigated pharmaceutical and medical device companies, home health care organizations, medical equipment companies, laboratories, physicians, and other health care providers, in cases involving violations of the federal health care fraud statute, False Claims Act, Anti-Kickback Law, HIPAA criminal violations, and the Food, Drug and Cosmetic Act. As a result of his investigations, Mr. Schumacher returned hundreds of millions of dollars to the federal government and convicted dozens of individuals of health care fraud charges, including several convictions following jury trials. Prior to joining the U.S. Attorney's Office, Mr. Schumacher practiced at one of the largest law firms in Boston, focusing his practice on white collar criminal defense and commercial litigation. Emily L. Brinkman is a senior counsel in the Litigation Department of Hooper, Lundy & Bookman. Her practice focuses on a wide range of matters related to hospitals, medical staffs, and other health care providers. Ms. Brinkman's broad experience spans federal, state, criminal, and civil defense work. A seasoned litigator, she previously served in the Health Quality Enforcement Section of the California Attorney General's Office. While there, she tried many cases on behalf of several state health care agencies, including the Medical Board of California, the Podiatric Medical Board of California, and Board of Psychology relating to quality of care, unprofessional conduct, sexual misconduct, out-of-state discipline, and petitions for reinstatement/early termination of probation. She advised clients on investigations prior to bringing disciplinary action and provided training to other attorneys within the Health Quality Enforcement section. Prior to this, Ms. Brinkman served in the Correctional Law Section (CLS) of the Attorney General's Office, where she defended the California Department of Corrections and Rehabilitation and its employees in civil rights case brought by inmates. While in CLS, Ms. Brinkman completed several jury trials (state and federal), all with defense verdicts in favor of her clients. She has also argued twice before the Ninth Circuit Court of Appeals. Gary F. Torrell

Gary Torrell is a partner in Hooper, Lundy & Bookman's Business Department and Co-Chair of the Health Care Financial Restructuring Practice Group. He has over 30 years of legal and business experience with a focus on business and finance, real estate, and creditors' rights. Mr. Torrell has a tradition of providing clients sophisticated business and legal advice coupled with a reasonable fee structure to provide exceptional value. He is both a transactional lawyer and a litigator, which makes his clients feel protected and prepared for virtually any circumstance. Mr. Torrell spent the first half of his legal career working at national law firms, where he handled creditors' rights and bankruptcy cases as well as real estate and lending transactions. He has appeared in bankruptcy courts across the country, and handled other matters including loan workouts, new loans and all types of real estate transactions. Mr. Torrell has also worked as in-house counsel for three companies: as Senior Counsel at City National Bank; Chief Legal Officer at Downey Savings (a $16 billion, publicly-held, 2,500 employee, 200-branch bank); and General Counsel to a privately-held $1 billion national real estate company. Ms. Hansen serves as co-chair of the firm's Medical Staff Practice Group and is a member of the firm's Fraud & Abuse Practice Group. Ms. Wicker received a Bachelor of Science degree, cum laude, in Biomedical Science from Texas A&M University and a Master's Degree in Public Health with a concentration in Epidemiology from San Diego State University. She earned her J.D., cum laude, from the University of San Diego School of Law, where she served as a Lead Articles Editor for the San Diego Law Review. While in law school, Ms. Wicker served as a judicial extern for the Honorable Gonzalo P. Curiel, U.S. District Court, Southern District of California, the Honorable Eddie C. Sturgeon, San Diego Superior Court, and Associate Justice Judith L. Haller, California Court of Appeal, Fourth District. She also completed internships with the U.S. Attorney's Office and the California Attorney General's Office. Ms. Wicker is admitted to practice law in the State of California and before the United States District Court for the Central and Southern Districts of California.
