Mediation provides the means to resolve a legal dispute on the day of the mediation. All of the parties to the mediation should be given an opportunity to be heard and each position should be considered in the quest to achieve a fair and mutually beneficial solution to the legal dispute...
To be successful, a mediator needs to be able to work with people. I enjoy people - even the difficult ones - and, most importantly, I enjoy finding a solution to their problem at hand. A fair and successful mediation gives a certain outcome of which the participants in the mediation have exclusive control. There will be final certainty as to the sums paid and terms agreed in closing the controversy. This is in contrast to the uncertain results that often come about after the time and expense that a trial brings down the road.
