Foster Wheeler

Foster Wheeler made boiler components, generators, and other heat and power-related machines with asbestos.[1][2] Foster Wheeler faced thousands of lawsuits over worker exposure in a range of industries, including the military.[3] Foster Wheeler began in 1927 as a merger between two other companies: the Power Specialty Company, which was originally the Water Works Supply Company started by the Foster family in 1884, and the Wheeler Condenser & Engineering Company, founded in 1891.[4] The original headquarters for the company was in New York City. Later, Foster Wheeler moved to New Jersey, Bermuda, and in 2008, Switzerland. Foster Wheeler eventually merged with British companies in similar industries, creating the Amec group. In 2014, Amec and Foster Wheeler came together to create a company specializing in international engineering, project delivery, power equipment, power consulting, and asset support.[4] In this way, Foster Wheeler possibly hurt thousands of people. Facility employees were at risk because they handled asbestos directly or were near areas asbestos was used. These employees could easily inhale asbestos fibers. Their families may also have been affected by asbestos fibers carried home on work clothes and shoes. Foster Wheeler's asbestos use also endangered workers in other industries that used Foster Wheeler products: Because Foster Wheeler put so many people at risk, the company has faced many lawsuits over resulting illnesses. Foster Wheeler was a defendant in a case brought by a shipyard worker employed at the Hunters Point Naval Shipyard in the 1960s and 1970s. He worked in the boiler rooms of U.S. Navy ships and was exposed to asbestos through Foster Wheeler products.[8] A court recently upheld a jury verdict for the wife of a man who worked in a Louisiana paper mill with Foster Wheeler boilers. Lynda Berry developed peritoneal mesothelioma and attributed it to the asbestos fibers her husband brought home on his clothing. The jury and court found Foster Wheeler liable for $2.25 million in damages.[9] Valent Rabovsky worked as a millwright for many years, beginning in the 1950s. He later died from mesothelioma. He and his widow believed it was the products containing asbestos in his work that caused his illness. They sued Foster Wheeler and others for damages. A jury awarded Mrs. Rabovsky $1.085 million. It assigned 20% of the liability to Foster Wheeler.[10] Richard Walmach worked near Foster Wheeler boilers during his career in the navy and as a civilian at Puget Sound Naval Shipyard. He reported being around workers who used jackhammers to remove the insulation from the boilers. He breathed in the resulting asbestos dust and died from mesothelioma in 2006. His family sued Foster Wheeler and other companies and received $5.2 million. Foster Wheeler was liable for $2.66 million.[11] These are just a few examples of thousands of cases Foster Wheeler faced. Despite the high number of cases, Foster Wheeler did not face bankruptcy, so it never established an asbestos trust fund to pay settlements. In 2014 a judge awarded eleven families of deceased workers over $90 million in damages. The judge held liable Anova Holding, AG and Becon, AG, companies that supplied Johns Manville with asbestos. Total awards to individuals varied.[3] Johns Manville, Manville New Jersey The Johns Manville Corporation used asbestos in many of its products, including insulation and construction materials. The company had factories around the country, and for decades workers in all of them worked with and around asbestos and were put at risk of becoming sick. New Jersey was a hot spot for the company and even has a town named Manville. A large factory there employed many residents. The facility, which shut in 1986, exposed workers years ago. Johns Manville led the way as one of the earliest companies to use asbestos in roofing, insulation, and other building products. After facing thousands of lawsuits, Johns Manville filed for bankruptcy in 1982. It became the first American company to create an asbestos trust for mesothelioma victims. Johns Manville's history began in 1858 when Henry Ward Johns used fabric and tar to create the first modern roofing shingles. He patented the design along with several insulation products. With these innovative construction products, he founded H.W. Johns Manufacturing. Johns Manville became the first company to file for bankruptcy over asbestos lawsuits in 1982. It was also the largest company to ever file for bankruptcy protection. The company reorganized and created the Manville Trust to compensate asbestos claimants. Today, Johns Manville is a subsidiary of Berkshire Hathaway. Workers make insulation, roofing, glass fiber, and non-woven materials at 43 manufacturing facilities. They are used in the construction, automotive, aerospace, waterproofing, filtration, and energy industries. Johns Manville was responsible for asbestos exposure in thousands of workers and others. These include its own workers, workers in other industries, family members of workers, and residents near Johns Manville factories. Family members of workers who handled Johns Manville products were also at risk of secondhand exposure. Workers often brought asbestos fibers home on their clothing, exposing members of the household. Johns Manville knew about the dangers of asbestos to human health for decades before it stopped using it. Not only did it not stop using asbestos, but Johns Manville actively hid evidence of the harm asbestos could cause. Evidence came to light beginning in the 1970s that Johns Manville executives suppressed information about the dangers of asbestos. This included changing research results or stopping researchers from publishing information about asbestos and health. In 1976, Dr. Kenneth Smith testified that he warned Johns Manville executives about the dangers of asbestos insulation in 1952. Smith was the medical director for the company.[4] Johns Manville faced asbestos-related lawsuits earlier than many other companies. This trend can be explained by the early and extensive use of this dangerous mineral. Johns Manville became a model for starting bankruptcy and reorganization with the foundation of a trust. A direct result of the Johns Manville bankruptcy was a new law passed by Congress that required companies with large asbestos claims to provide a trust fund as a component of bankruptcy protection. William Trokey

William Trokey worked on Ford brake drums as a teen and young man in the 1960s. Now 76, he has mesothelioma. Brakes have long contained asbestos to reduce the harmful effects of friction. Mechanics were exposed to asbestos dust when working on brakes. Trokey and his wife sued Ford over past asbestos exposure to cover the costs of his medical care.
