In the case of Riley v Direct Line the EAT confirmed that the termination of employment on ill-health grounds can be regarded as ending the contract of employment by mutual consent ( rather than dismissal) provided it was clearly consensual . Ideally then under a settlement agreement whereby the departing employee gets legal advice first.
