Allison L. Davis is a member of Brown & Fortunato's Labor and Employment law team, where she is a shareholder and director. She is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization. She practices primarily in employment litigation, employment counseling, and commercial litigation. Allison represents clients in a wide range of litigation and pre-litigation matters, including employment discrimination, non-competition disputes, wage and hour issues, and business disputes.
Allison frequently advises employers on exemption, classification, and pay issues and often drafts and advises employers on the enforceability of non-competition, severance, and confidentiality agreements. In addition, Allison routinely handles internal investigations as well as audits and investigations by the Equal Employment Opportunity Commission, Department of Labor, and Texas Workforce Commission. Allison also drafts employee handbook policies and procedures and advises employers on proper hiring, disciplinary, and termination practices.
Allison is a member of the State Bar of Texas, Amarillo Area Bar Association and the Amarillo Young Lawyers Association. Allison was raised in Angleton, Texas and graduated from Angleton High School. She attended Austin College in Sherman, Texas, where she earned a B.A. in Communication Arts and a minor in French. Allison was named to the Dean's List on several occasions and graduated summa cum laude.
In 2005, Allison enrolled at Texas Tech University School of Law, where she received the Regent's Scholarship for academic achievement. In addition, Amanda has more than a decade of experience in health care litigation, representing physicians and other health care providers in medical malpractice lawsuits.
At Brown & Fortunato, Amanda combines her experience in-house and in private practice in representing a wide array of health care entities on complex health care regulatory and compliance matters.
Amanda attended the University of Texas at Arlington where she received a Bachelor of Arts in Political Science, graduating magna cum laude. She then attended Baylor University School of Law, graduating cum laude in 2010. While at Baylor, Amanda served as an Associate Editor on the Baylor Law Review and as AAJ Mock Trial Team Evidence Coach. She also received awards for her excellence in evidence and civil procedure.

Blinn Combs joined Brown & Fortunato as a member of the firm's Health Care Group, where he advises a broad array of health care providers on risk mitigation, regulatory compliance, state licensure, and various provider network enrollment matters. Prior to joining Brown & Fortunato, Blinn served as in-house counsel for a group of healthcare companies in Georgia, including a national mail order pharmacy and a pharmacy hub services provider, advising on regulatory compliance matters and drafting and negotiating contracts.
Blinn obtained his J.D. from Georgia State University in 2017, where he received CALI awards in Jurisprudence and Public Health Law and a Best Brief award. Prior to law school, Blinn worked in commercial and residential real estate and spent two years teaching at Trinity University in San Antonio.

Bradley S. Byars serves as a Senior Attorney in the Health Care Group of Brown & Fortunato. Before joining the firm, Brad served as Senior Associate General Counsel to an international private equity backed cancer care company and was primarily responsible for the company's East coast and Midwest operations.
Brad brings more than a decade of experience in healthcare law, including in roles as in-house corporate counsel and chief compliance officer. He focuses on regulatory compliance, complex healthcare transactions, clinical trials, payer reimbursement strategy, Accountable Care Organizations, Medicare Managed Care Organizations, and operational issues for healthcare organizations of all sizes. Brittany Hinton joined Brown & Fortunato as a member of the firm's Labor and Employment Law Group. Well respected in the home medical equipment and complex rehab technology industries, Cara is an attorney, lobbyist and trusted resource on legislative and regulatory matters related to Medicare, Medicaid, and other third-party payment programs. For 30 years, she has been working on behalf of the industry and companies with the Centers for Medicare and Medicaid Services (CMS), the Food and Drug Administration (FDA), and other federal agencies.

Colleen is a senior attorney and member of Brown & Fortunato's Health Care Group. She is based out of the firm's Dallas office and represents hospitals, pharmacies, durable medical equipment suppliers, home health agencies, and hospice providers in a wide variety of healthcare regulatory matters.
She advises clients on laws applicable to state licensing standards; program enrollment, reimbursement and administrative appeal matters; Medicare Conditions of Participation; Medicare and Medicaid coverage requirements; the federal Anti-Kickback Statute, Stark law, and the Health Insurance Portability and Accountability Act (HIPAA). Colleen assists providers in governmental investigations and with various fraud, waste and abuse situations. Denise M. Leard draws from a diverse legal experience to contribute to the Health Care Group at Brown & Fortunato.
Denise joined Brown & Fortunato as a member of the firm's Health Care Group where she has a national health law practice and is a shareholder in the firm. She is Board Certified in Health Law by the Texas Board of Legal Specialization. As part of the Health Care Group, she works closely with the Department of Justice, Office of Inspector General, Center for Medicare and Medicaid Services, Durable Medical Equipment Regional Carriers, Uniform Program Integrity Contractors, National Supplier Clearinghouse, and other federal and state regulatory agencies. She represents durable medical equipment companies, pharmacies, home health agencies, hospices, hospitals, physicians, and other health care providers in a large variety of legal areas.
Denise advises clients on compliance with federal and state laws that impact the health care industry. One of Denise's favorite roles is assisting the firm's health care clients with compliance issues and providing preventative education. She is frequently involved in the appeal of Medicare overpayment demands or denial requests where she plays a key role in guiding clients through the administrative appeals process. Denise has successfully defended extrapolated audits at the redetermination and reconsideration levels, avoiding the need to continue to an administrative law judge level. Denise finds working appeals and assisting clients in being removed from prepayment review very rewarding.
Denise is also instrumental in assisting suppliers and providers in all areas of enrollment and revalidation and responding to investigations by CMS enrollment contractors. This includes assisting suppliers with the accreditation process including preparing the necessary evidence for the accrediting organization and conducting a mock survey.
Denise was born in Colorado but spent most of her youth in California and Washington before finding her home in Amarillo. Denise received her B.A. in Business Administration from the University of Washington in 1988. While in college, she was a member of the swim team and broke numerous school and meet swimming records. Her athletic talent was recognized when she was named a College All-American in 1985 and 1986.
After completing her undergraduate education, Denise moved to Norman, Oklahoma, where she worked in a law firm before enrolling at the University of Oklahoma College of Law in 1990 where she received her J.D. in 1993.
Denise is a frequent speaker at professional and trade conferences including state, regional, and national conferences on many topics including audits, appeals, and general health care issues affecting the firm's clients. Denise has presented programs to attorneys and compliance officers at the Health Care Compliance Association's Compliance Institute. In addition, she has authored numerous articles covering a variety of health law topics and can be found in publications such as Homecare Magazine, HME News, and Compliance Today. She is on the Board of Commissioners for the Accreditation Commission for Health Care where she holds the position of Immediate Past Chair.
Denise also stays active in her community. She is a 2004 graduate of Leadership Amarillo-Canyon and served on its Board of Directors from June 2004 to June 2006. She served on the Board of Directors and the Executive Committee for the High Plains Division of the March of Dimes and was Board Chair from 2006 to 2010. Denise co-chaired the Fall 2006, 2007, 2008, and 2009 Amarillo Signature Chef's event. She chaired the Logistics Committee for that event in 2010 through 2012. She previously served on the March of Dimes Texas State Advocacy Group. She also previously served as a member of the local board for the Juvenile Diabetic Research Foundation. She currently serves on the Brandy Lee Leard Scholarship Board.
Denise is married to Charles and has five children: Daniel, Michael, Zachary, Jacob, and Katherine. In her spare time, Denise enjoys physical activity, has competed in triathlons, and has completed a full Ironman event. She previously held the position of Head Swim Coach for the middle and high school students at Ascension Academy. Eric Matthews is a member of Brown & Fortunato's Corporate Group, with a transactional practice that includes mergers and acquisitions, corporate governance, and real estate. He advises owners and executives at every phase of the business cycle, from formation to termination, and has experience handling a variety of equity and asset transactions, restructuring corporate entities, and negotiating various agreements with suppliers, vendors, and other third parties.
Eric is a member of the State Bar of Texas, the Amarillo Area Bar Association, and the Amarillo Young Lawyers Association. Eric was selected by Thomson Reuters as a Super Lawyers Rising Star in the State of Texas for 2023 and 2024, a distinction awarded to only 2.5% of eligible attorneys. He earned both his Bachelor of Business Administration and Juris Doctor, magna cum laude, from Texas Tech University. During his undergraduate studies, Eric formed and operated two companies, a recycling business and landscape design business, both of which he later sold. Perhaps the most valuable work Eric does is halfway around the world. Eric and his wife, Kimberly, founded and operate 25:35 Water, a 501(c)(3) organization, drilling water wells and providing food and medical supplies to impoverished areas of Uganda, Africa. Since its inception in 2016, 25:35 Water has drilled more than 70 water wells across Uganda.

After 18 years of private law practice at a leading Dallas law firm and 5 years serving as general counsel for one of Texas' largest home health care providers, Gregg R. Cannady joined Brown & Fortunato, where he is a shareholder.
Gregg has a general business practice focusing on mergers and acquisitions, corporate finance, corporate governance, business start-ups and general business advice. In his transactional practice Gregg has served as the principal legal advisor on numerous mergers, acquisitions and divestitures in a variety of industries to help clients achieve growth, streamlining or exit strategies. Gregg has negotiated and drafted purchase and sale agreements, merger agreements and ancillary documents such as employment and consulting agreements, confidentiality and non-compete agreements, earn-outs and escrow agreements.
Gregg has also served as the lead legal advisor to borrowers in securing funding to support the growth of the business and in structuring and implementing recapitalization plans. In that capacity, he has negotiated and drafted loan documents and related instruments such as guarantees, security and pledge agreements, promissory notes and the like.

Gregg was born in Guymon, Oklahoma and grew up in West Texas. After graduating from Lamesa high school, Gregg attended Rice University on a football scholarship where he was a member of the Rice Owls football team during his four years in Houston. After receiving his B.A at Rice, Gregg attended the LBJ School of Public Affairs at the University of Texas at Austin and received his M.P.A in 1979. Jason E. Pepe is a shareholder and member of Brown & Fortunato's Litigation Group. He has significant experience in business, health care, oil & gas, and products liability litigation. Jason was previously a litigation partner in an AmLaw 100 law firm. Jason has tried many cases to verdict and litigated hundreds of cases in federal and state courts across the United States. He has extensive appellate experience, recently arguing appeals before the Ninth and Eleventh Circuits. Jason's two and a half decades of sophisticated practice on behalf of corporate clients enables him to assist clients in successfully navigating the world of high stakes litigation.
Before becoming an attorney, Jason was commissioned as an officer in the United States Army. In 1996, he was a platoon leader and deployed with the Army's First Armored Division in support of Operation Joint Endeavor in Bosnia-Herzegovina.

Lisa Smith has been advising clients on health care legal matters for over 30 years. She joined Brown & Fortunato more than 25 years ago, and she is currently of counsel. She has a strong background in regulatory compliance and frequently assists clients with contractual arrangements and reimbursement issues. Lisa is routinely involved in analyzing arrangements under the various federal and state fraud and abuse laws, and represents pharmacies on a wide variety of issues including compounding parameters. She assists the firm's health care clients with payor audits, due diligence reviews, and health care regulatory compliance issues in general. Lisa has expertise in physician recruitment, managed care contracts, open meetings/open records requirements, and billing audits. She also has considerable experience in assisting health care providers with voluntary disclosures and responding to governmental investigations.
Though she was born in Santa Monica, California, Lisa has spent almost all of her life in Texas and is currently based in the San Antonio area. She received her undergraduate education at Stephen F. While at the Utah Attorney General's Office, Matthew developed a special interest in governmental immunity under 42 U.S.C. Section 1983 and Title IX.
Matthew attended Utah State University on a music scholarship. He was recruited to Utah State to start the university's bagpipe band, the Utah State Scotsmen Pipe & Drum Corps. He graduated from Utah State in 2016 with a Bachelor of Science in Law and Constitutional Studies.
In 2019, Matthew received his Juris Doctor from the J. Reuben Clark Law School at Brigham Young University. While in law school, Matthew was a member of the Trial Advocacy team and worked part-time for the Utah Attorney General's Office.
Matthew and his wife, Hayden, are avid sports fans and enjoy playing tennis and golf together.

Melinda Newman is a Senior Attorney in the firm's Labor and Employment Group where she represents clients in employment counseling and litigation matters. As a former federal government attorney, Melinda has significant experience representing managers in administrative matters before the Equal Employment Opportunity Commission and Merit Systems Protection Board, as well as arbitration matters before the Federal Labor Relations Authority. Michael R. Alexander is a shareholder at Brown & Fortunato, and his practice focuses on health law. Nolan was born and raised in Wichita Falls, Texas. In 2020, he graduated with distinction from Oklahoma State University with a Bachelor of Science in Political Science. In 2023, Nolan received his Juris Doctor from the University of Oklahoma College of Law.
While at OU, Nolan helped develop the Oklahoma Athletic Department's Name, Image, and Likeness strategy, addressing various legal issues and drafting legislation, and interned at the Wichita Falls District Attorney's Office. Phuong D. Nguyen is a senior attorney at Brown & Fortunato and a member of the Health Care Group. Phuong is based in the Houston area and has extensive experience in health care regulatory matters, compliance and privacy. He is a member of the American Health Lawyers Association, Health Care Compliance Association, and is Certified in Healthcare Compliance (CHC) by the Compliance Certification Board.
In addition, Phuong has experience serving in health care compliance roles for a large non-profit health care system, where he developed and was responsible for the day-to-day operations of the compliance program for a region with multiple hospitals, an accountable care organization, and an affiliated non-profit, multi-specialty physician group. Immediately prior to joining Brown & Fortunato, he served as the Compliance Officer for a leading heart research institute and affiliated physician group.
Phuong attended Southwestern University on a viola performance scholarship, where he received his Bachelor of Arts in Math and Philosophy. After college, Phuong pursued several interests, including an interest in music by teaching Suzuki violin and viola for the University of Texas at Austin String Project, and then in public school and private settings.
