Emily Marshall

Emily Marshall is an associate with Miller O'Brien Jensen. Emily came to the firm in 2013 with a keen interest in defending workers' rights and is proud to represent people and groups in their disputes with their employers. Emily's employment law practice focus on representing employees in civil state and federal court litigation, as well as administrative forums such as the Equal Employment Opportunity Commission ("EEOC") and the Minnesota Department of Human Rights ("MDHR"), and in private arbitration forums. She is well-versed in a variety of alternative dispute resolution ("ADR") methods. Emily has handled cases involving many forms of discrimination, sexual harassment, pay equity, wage theft, retaliation and whistleblower claims, "ERISA" disputes, non-competition agreements and other restrictive covenants, employment contract disputes, defamation, and severance negotiations. She enjoys working with clients to understand the particular political dynamics of their workplaces and developing strategies that serve their goals.

M. William O'Brien

Bill O'Brien is a founding partner of his Firm, Miller O'Brien Jensen. For 30 years he has practiced exclusively in the areas of workplace law, employment rights and labor law. His client-focused practice entails constant strategic positioning, counseling, negotiation, arbitration and litigation on behalf of his clients. Bill has litigated and arbitrated hundreds of cases, obtaining substantial relief for his clients in single and multiple Plaintiff cases, as well as in class and collective actions. Bill has been designated a Minnesota Super Lawyer in every year such designations have been made. Since 2001 Bill has been identified as among the Best Lawyers in America. In 2012 Best Lawyers designated Bill as the Minneapolis Lawyer of the Year in the employment law category. He has secured the highest rating, AV Preeminent, from the Martindale Hubbell lawyer rating service. U.S. News and Chambers USA, have ranked Bill's firm as among the nation's best employment law firms. In 2006, Bill was admitted as a Fellow to the College of Labor and Employment Lawyers, an association of the nation's leading labor and employment lawyers. Bill is the former Chair of the Labor and Employment Section of the Minnesota Bar Association and former President of the National Employment Lawyers' Association, Mn Chapter. In 2018 Bill was made a Fellow of the American Bar Foundation. The ABF is an organization of leading lawyers, judges, law faculty and legal scholars who have been elected by their peers to become Fellows because of their outstanding achievements in the legal profession. The ABF seeks to expand knowledge and advance justice through innovative, rigorous and cutting-edge research to inform and guide the legal profession.

Nick Kaylor

Nick Kaylor is an associate attorney with Miller O'Brien Jensen. Nick came to the firm in 2019. He proudly hails from a family with strong labor roots. Nick applies this background to passionately guide clients through a variety of labor and employment issues. Nick represents employees in federal and state labor and employment law matters. Nick counsels employees on a variety of employment law issues including employment discrimination, wage and hour issues, family medical leave, and employee benefits. Nick also has experience with assisting clients in reviewing, negotiating, or litigating issues related to, employment agreements and noncompetition agreements. Nick also represents unions and their members in the processing of grievances, arbitrations, contract negotiations, unfair labor practice charges, union duty of fair representation disputes, and other contract issues. He maintains an active pro bono practice, assisting individual clients in housing and creditor collections matters. Nick graduated from the University of Minnesota Law School in 2019. During law school, he was a judicial extern with the Hon. Amy Dawson of Minnesota's 4th Judicial District, served as an Online Articles Editor of the Minnesota Law Review, and was a Student Director with the James H. Binger Center for New American's Detainee Rights Clinic. He also volunteered with the Asylum Law Project and the Minnesota Justice Foundation. Nick lives with his wife Cieria and their two Scottish terriers. When they're not walking their dogs with a coffee in hand, you can find them in St. Paul at a Minnesota United game.

Rich Miller

Rich Miller began practicing with Sam Sigal in 1966 after his active duty in the Navy and after graduating from the University of Minnesota Law School. Rich's roots and influence in the employee advocacy movement were wide and deep. He represented hundreds of labor organizations and employees for several decades, and he was the visionary behind some of the most significant labor-side legal and strategic initiatives in the last 20 years, including the use of Fair Value Contracting, Project Labor Agreements, and Market Recovery Programs. Prior to his retirement in 2007, Rich received the Minnesota State Bar Association's Leonard Lindquist Distinguished Practice Award, an award that recognizes outstanding contributions to the field of employment and labor law. Rich and his wife Sylvia now reside in Tuscon, Arizona. The firm's name changed in 1985 when Bill O'Brien joined forces with Rich Miller. This also coincided with the "big bang" in employment law in the 1980s. Over the next 30 years, Bill won hundreds of settlements, verdicts, and arbitration awards. Among these was the first whistleblower verdict in Minnesota for an employee, the nation's largest pre-suit settlement of a sex discrimination class action, and Minnesota's largest judgment in a housing discrimination case. More recently, in 2010, the firm joined forces with its most capable competitor, Roger Jensen. After receiving his law degree in 1967, Roger joined the Marine Corps and Judge Advocates General (JAG) Corps where he became a captain, serving as prosecutor and defense counsel in the U.S. Courts Martial. Upon his military discharge in 1971, Roger began his forty-year-plus career as a labor lawyer. He was principal and managing partner at Jensen, Bell, Converse & Erickson before aligning with Miller and O'Brien. At MOJ, Roger represented clients in all aspects of labor and employment law and was counsel to multiple Twin Cities suburban municipalities. Roger was also a recipient of the Minnesota State Bar Association's Leonard Lindquist Distinguished Practice Award in 2011. Roger retired in 2020 and continues to live in St. Paul with his wife Sarah. Today, the attorneys at Miller O'Brien Jensen, P.A. proudly draw on this foundation of institutional knowledge to provide clients with insightful, informed, and reliable advice and counseling.

Tim Louris

Tim Louris is a shareholder with MILLER O'BRIEN JENSEN. Tim came to the Firm in 2010 with a proven record of helping employees resolve issues in the workplace. Tim's employment law practice focuses on representation of individual employees in civil state and federal court litigation, and Tim has handled cases involving issues of disability discrimination, Family and Medical Leave Act ("FMLA") violations, Occupational Health and Safety Act ("OSHA") violations, age discrimination, race discrimination, wage and hour issues, defamation, contract disputes, non-compete issues, and severance agreement negotiation. Aside from his work in the courtroom, Tim regularly represents clients in forums such as the Equal Employment Opportunity Commission ("EEOC"), the Minnesota Department of Human Rights ("MDHR"), and the Minnesota Office of Administrative Hearings.
