David Outwater has practiced in Orange County, California since 1995. His practice emphasizes complex business litigation matters in a wide ranging variety of industries. In the Newport Beach office of Stradling Yocca Carlson & Rauth from 1995 to 2004, he represented clients in litigation involving all aspects of residential and commercial real estate disputes, defended and prosecuted state and federal antitrust matters (published case at Nova Designs v. International PADI, Inc., et al., 202 F.3d 1088 (9th Cir. 2000)), represented clients in connection with internet defamation actions and business torts, and has actively defended and prosecuted shareholder derivative lawsuits (published case at Avikian, et al. v. WTC Financial, et al. (2002) 98 Cal. App. 4th 1108). In 2004, Mr. Outwater co-founded Outwater & Pinckes, LLP with his wife and law partner. Mr. Outwater continues to successfully handle business-related litigation disputes of wide-ranging type and importance, including tortious interference, trade secrets, fraud, breach of contract, shareholder and partnership disputes, business dissolution, real estate litigation (lease disputes, unlawful detainer, quiet title, trespass, and nuisance), and has a proven track record in handling executive-level compensation and bonus disputes. Recently, Mr. Outwater successfully argued before the Second Appellate District Court regarding a cutting-edge legal issue regarding tortious interference law, which is published at Redfearn v. Trader Joe's (2018) 21 Cal. App. 5th 166.
