Evan Levow served as attorney for the lead defendant in the groundbreaking New Jersey Supreme Court case of State v. Chun, which had implications for breath testing in DUI cases across the state and nationwide. Mr. Levow also represented key defendants in State v. Kent and State v. Renshaw, influential New Jersey court decisions that changed the landscape of presenting blood-testing evidence in cases at trial through witness testimony. In doing so, he reaffirmed the defendant's fundamental constitutional right to confront witnesses against him or her. Kent and Renshaw provided the right to confront witnesses prior to the now landmark confrontation cases, Crawford and Bullcoming. In 2013, Evan Levow made national and local headlines as he argued before the New Jersey Supreme Court for the immediate discontinuation of the Alcotest due to significant flaws with both the machine and New Jersey's breath testing program. Evan is representing the DUI Defense Lawyers Association as Amicus in State v. Olenowski, the case challenging the reliability of the Drug Recognition Evaluation (DRE) Protocol.
