EDDY AZHAR OTHMAN

Ts. Eddy Othman is a construction planning professional with over 19 years of hands-on experience in construction management and planning. Eddy started his career in construction managing civil and building works for several construction companies. He quickly developed a keen interest in construction planning and have specialised in planning and scheduling since 2006, working for specialist planning firms and main contractors on landmark projects such as the National Heart Institute (IJN) and the Second Penang Bridge in Malaysia. Having developed expertise in the use of Critical Path Method (CPM) for implementing project planning with programming systems such as Oracle Primavera and Microsoft Project, Eddy is skilled in the interrogation of project schedules to identify critical activities and resource constraints by adopting the appropriate prospective or retrospective methods of analysis. Subsequently Eddy moved into the field of construction claims consultancy with Charlton Martin Consultants where he specialised in the preparation of Extension of Time (EOT) claims for contractors as well as assessing and independent review of Contractor's extension of time application by using the appropriate CPM delay analysis technique in analysing the cause and effect of delay events and quantifying the extent of excusable and culpable delay within the periods of delay analysed. In this regard Eddy is a valuable resource for our delay expert appointments, particularly when there is a need for large scale reconstruction of as-built programmes from contemporaneous records over the life-cycle of the project, where a critical analysis of the effect of causative events identified by our delay expert is an important part of the evidence necessary to arrive at an opinion on the contractual risk and liability issues arising from delay and disruption. Over the years Eddy have performed delay analysis for disputed matters referenced to court, arbitration and adjudication, including claims and counterclaims on delay to LNG production and storage facilities, oil & gas pipelines, high-rise mixed developments, hotels, hospitals and office buildings, highways, roads, bridges and other infrastructure projects. Eddy holds qualifications in Civil Engineering and a Masters degree in Project Management. A Certified Planning Engineer, Eddy is a Member of the Institution of Engineers Malaysia and the Malaysian Institute of Arbitrators. He heads our forensic delay and planning services, and he has experience in providing expert opinion on the causes of delay and extension of time entitlement for dispute resolution proceedings. Ms Goh Li Kian graduated with a degree in civil engineering in 2007, and began her career as a planning engineer, working on developing schedules and programmes for numerous major infrastructure projects, including LRT and Airport extension works. In 2011 Li Kian moved to an assistant planning manager role with MMC-Gamuda for the construction of the SBK and SSP Line underground works for some 7 years. During this period Li Kian developed her skills in delay analysis necessary for the preparation of contractual claims. Having spent a brief period at Gadang E&C managing EOT claims, Li Kian joined CSi's Forensic Delay & Planning team in 2019 to further her career in dispute resolution. Li Kian's recent appointments include retainer services for EOT assessment on several MRT, Highway and High Rise construction projects. She is also assisting delay expert in the preparation of delay expert report for a disputed oil processing plant project and a solar plant construction project. Apart of delay analysis work, Li Kian is also engaged to represent client on CIPAA proceedings in relation to disputed interim and final claims between main contractors and sub-contractors. Li Kian is a certified Project Management Professional, a Fellow of the Chartered Institute of Arbitrators UK and a Member of the Malaysian Society of Adjudicators. Ms Joni Chu has over 30 years of working experience in the construction, engineering and oil & gas industries in various corporate financial accounting and project cost accounting roles, as well as performing procurement, tendering, estimating and co-ordination duties during her employment with local and multinational companies. With the wide-ranging experience gained throughout her career Joni is able to quickly understand the cost accounting structure of construction and engineering related businesses, where her insight is vital to unraveling the complex cost data often encountered on major construction projects. Joni is skilled in forensic analysis of cost accounting records and data in identifying or verifying relevant cost heads for direct loss and expense related to delay and disruption cost claims, as well as site and head office overhead costs, asset depreciation, cost escalation, loss profits and financing cost claims commonly associated with claims for damages arising from construction contract disputes. By detailed assessment and cost modeling techniques, Joni can conduct a technical audit by a complete examination of all financial transactions during the life-cycle of a construction contract in order to establish the relevant facts and costs. She provides valuable support to our dispute resolution team in determining the appropriate quantum of dispute. PING ZHIOW GIN

Miss Ping Zhiow Gin started her career in the construction industry in 2010 with cost consultants YSCA Consultancy, performing quantity surveying duties for a range of projects. During this period Zhiow Gin gained valuable experience in cost valuation, value engineering, tender processes and contract administration. In 2015 Zhiow Gin moved into construction, initially working with a local building contractor, and later joined established Chinese foundation contractor Zhongji Construction in 2016. The construction experience allowed Zhiow Gin to develop her skills on the commercial aspects of the business, ranging from budgeting, procurement, cash flow and negotiations, as well as the contractual aspects of claims, notification, disputed variations and final accounts. Zhiow Gin joined CSi's dispute management team in 2019 and plays a key role in the firm's adjudication and arbitration work. Notable recent appointments include acting for a main contractor in pursuit of multiple adjudication claims against the same employer for three resort developments in Johor, assisting counsel in an arbitration for a disputed hospital construction project in Pahang, as well as retainer services for an on-going renovation of a 5-star hotel in Kuala Lumpur. At the same time Zhiow Gin pursued a bachelor's degree in Jurisprudence on a part-time basis and graduated in 2023. Miss Wong Jian Bei graduated from the National University of Singapore with a degree in Project and Facilities Management in 2012, and began her career in facilities management at the landmark Gardens by the Bay, Singapore. Subsequently she moved into the field of construction scheduling with Sinohydro, where she developed experience in construction management & scheduling. In 2015 Jian Bei began her career in construction claims consultancy with BK Burns & Ong, specialising in the preparation of Extension of Time (EOT) claims. Since joining CSi in 2016 Jian Bei focuses on delay expert witness assignments, and drafting submissions for adjudication proceedings. At the same time she completed her Master degree in Construction Law & Arbitration with merit. Jian Bei leads CSi's Forensic Planning & Delay Services in our Kuala Lumpur office. Her recent appointments include acting as expert witness on delay for the external works of a power plant project, and a Malaysia Government water supply project, as well as advisor to parties on on-going buildings and infrastructure projects. Edward started his professional career as a Post-Contract Executive back in 1994 with a Civil Engineering Contractor working on major infrastructure projects such as dam construction, water works, marine reclamation and railway track works. Edward became involved in dispute resolution in 2007, where during his employment with contractors he was tasked with supporting legal counsel to provide input for claims and defence involving final account, variation, EOT and loss and expense disputes. During this period he developed an interest in the law and eventually led him to reading law with the University of London. Edward was appointed Contracts Manager with the KVMRT Line 1 (Design, Procure and Construct for Underground Stations and Tunnel) project in 2012, where he led the contracts team until its completion in 2017. He was actively involved during the construction stage where he demonstrated sound project, contract and commercial management skills, and his ability to successfully negotiate supplementary agreements for final accounts and mitigate potential contractual disputes is well recognised by the project team during this period. With his 25 years' working experience in major infrastructure works, Edward joined CSi as a Partner in 2018, to enable him to focus on his interest in resolving construction disputes.
