Jason A. Miller

Professional Experience In his professional career, Jason has experience as an executive, a director of business development, a director of operations, a business consultant, a sales representative, a retail manager, and an accounting technician. After working as an Accounting Technician at the University of North Carolina at Chapel Hill, Jason accepted a business consulting position with one of the nation's largest non-profit animal-related organizations. In short order, Jason was promoted through various positions, ultimately becoming the highest ranking employee of a multi-million dollar corporation. In this role, Jason managed dozens of employees including a call center, a marketing department, an information technology department, and a sales department. Jason negotiated partnerships with multi-national corporations, managed the creation, launch, and distribution of several successful products, and contributed to a national effort to standardize microchip technology. It was these experiences that inspired Jason to attend law school. His regular interactions with lawyers and law firms exposed him to a gaping hole in the legal community. He found that most business lawyers were focused on identifying risks and finding roadblocks, but only had a superficial understanding of the business world and how to guide business leaders to navigate the legal process to meet strategic goals. A lawyer with a depth of business experience in executive leadership, marketing, operations, information technology, and sales would be better suited to provide legal guidance in the context of the client's business. A holistic approach that accounts for the businesses' strategic goals and layers these goals over the risks and opportunities presented in litigation. This is what Jason Miller and Miller Monroe & Plyler bring to the table. And after serving business clients for more than a decade, it is more clear than ever that a deep business skill set not only provides a tremendous advantage to business clients in litigation - it is core requirement for helping clients effectively navigate often complex legal matters while maintaining a focus on serving the businesses' strategic needs. Jason Miller has experience in state and federal courts. He has represented Fortune 500 companies in complex business litigation matters, builders and developers in real property disputes, individuals seriously injured in car accidents, investors sued in business deals gone awry, and dozens of cases in between. Jason has litigated matters in more than a dozen counties in North Carolina and is licensed to practice in every state and federal court in North Carolina. In 2015, Jason was also licensed to practice law in the State of New York.

Jennifer C. Garvey

Professional Experience Jennifer Garvey joined Miller Monroe & Plyler as a paralegal in June 2016. Jennifer is a 2006 graduate of East Carolina University with a Bachelors of Science in Criminal Justice. She went on to obtain her Master's Degree in Criminal Justice from the University of Central Missouri in 2012. Jennifer worked as a Police Officer, Detective, Evidence Technician, and Crime Analyst for a Wake County municipality from 2007 - 2014 before joining the North Carolina State Crime Laboratory in Raleigh, NC as an Evidence Technician until 2015. In 2016, Jennifer completed the Paralegal Certificate Program at University of North Carolina at Chapel Hill. Personal Jennifer is originally from the Tidewater region of southeast Virginia. After attending school at East Carolina University, Jennifer accepted a job in Wake County and decided to make her home in North Carolina. Jennifer enjoys spending her free time with her family and friends, reading and gardening. She also enjoys cooking and trying new recipes.

John W. Holton

John is a trial lawyer with experience handling an array of civil lawsuits. His two primary practice areas are representing plaintiffs in serious personal injury matters and companies in business disputes. In his personal injury and wrongful death practice, he has litigated cases involving products liability, medical malpractice, nursing home negligence, premises liability, and trucking accidents, among others. In the past few years, John has tried medical malpractice and premises liability cases to jury verdict. In his business and commercial litigation practice, he has represented companies with claims involving intra-corporate disputes, unfair and deceptive trade practices, fraud, and breach of contract. John recently completed a two-week bench trial with over $1.2 billion at issue stemming from the defendants' fraud and breach of contract. Prior to joining Miller Monroe & Plyler, John spent nearly a decade practicing as a defense attorney with prominent regional law firms where he represented Fortune 500 companies, large insurers, and hospital systems. John is able to leverage his experience working for those large organizations to effectively represent the less powerful. John comes from a family of lawyers, and the impact the legal system can have on its citizens-positive and negative-was impressed upon him from an early age. After college, John worked for a large national law firm as a paralegal where he was a member of the trial team for a wrongfully convicted United States Senator. NPR Link. In addition to fostering a love for trial work, this experience demonstrated how the courts can be used and misused in the pursuit of justice.

Paul T. Flick

Professional Experience Paul has more than 35 years of experience representing businesses and individuals in civil litigation. After serving as the Managing Partner of a prominent Raleigh firm for more than 15 years, Paul joined Miller Monroe & Plyler to continue his focus on business and commercial litigation, mediation, arbitration, and administrative law. He represents business clients in a variety of matters, including shareholder and LLC member litigation, collections, contract disputes, and variety of other civil matters. Paul is a NCDRC Certified Civil Superior Court Mediator, often mediating family and business disputes and serving as an arbitrator, as well. He is a frequent lecturer and has written numerous articles on legal ethics, civil practice, mediation, and the rights of creditors. Paul's notable clients have included national lenders, loan servicers, regional banks, and individuals on creditor's rights matters throughout North Carolina, companies and principals in complex shareholder/membership disputes, and international corporations, contractors and individuals in large arbitration matters.

Robert B. Rader III

Professional Experience Rob joined Miller Monroe & Plyler as an associate attorney in September of 2019. His practice focuses on commercial litigation, complex business disputes, sports law, corporate and partnership governance, appellate advocacy, and general civil litigation. Rob has represented a wide variety of clients, including corporations, start-ups, partnerships, and their respective offers, members, and shareholders. Appearing in North Carolina trial, appellate, and federal courts, he has successfully prosecuted and defended disputes related to breach of contract, fraud, fiduciary duties, unfair and deceptive trade practices, and internal management issues, among others. Alongside Jason Miller, Rob spearheads MMP's sports law practice, providing comprehensive representation and counsel to corporate and athlete clients in the industry. He has recently presented for seminars and CLEs on emerging collegiate athletics issues and name, image, and likeness (NIL). Rob received his law degree from the University of North Carolina School of Law, where he was a member of the Broun National Trial Team and the Julius L. Chambers Civil Rights Advocacy Team of Holderness Moot Court. In addition, Rob spent a summer studying international law and human rights at the London School of Economics in London, England.

Will Smith

Will has over 14 years of experience representing and advising large institutional clients in disputes and civil litigation. This career has afforded him a number of insights as to how organizations and institutions make decisions regarding litigation, risk management, and negotiations. Will's practice focuses on eminent domain and land condemnation; zoning and land use disputes; construction litigation; as well as general civil litigation. Will graduated from Campbell Law School in 2007 and went to work at Hedrick, Gardner, Kincheloe & Garofalo, a law firm that primarily represents insurance companies in civil disputes. At Hedrick Gardner, Will gained experience in multiple areas of the law, including personal injury litigation, construction litigation, and workers' compensation. While at Hedrick Gardner, Will's experience showed him how large insurance companies make decisions regarding settlement negotiations and litigation. In 2012, Will went to work at McGuireWoods, an international law firm with over 1,000 attorneys, where he represented one of the largest banks in the country in mortgage disputes and Fair Credit Reporting Act cases. During his time at McGuireWoods, Will gained experience in Federal litigation and saw how large financial institutions litigate against individuals. In 2014, Will decided to pursue public service and took a position as Deputy General Counsel with the North Carolina Department of Transportation (NCDOT). As Deputy GC, Will advised the NCDOT on a broad array of legal issues and saw how the Department made decisions from the inside.
