Caroline Fitzgibbon

Caroline is a senior solicitor in our Litigation and Private Client Department and heads up our Family Law Unit. With over 20 years of extensive experience, Caroline plays a valuable role in several MHP Sellors practice areas, including Dispute resolution, Clinical Negligence; Family Law, Serious & Catastrophic Injury and Landlord and Tenant litigation. Caroline is highly experienced in all aspects of family law, including divorce, judicial separation, the financial consequences of marital breakdown, recognition of foreign divorces, civil partnership, cohabitation and non-marital relationships. She also operates in the areas of dispute resolution and both residential and commercial property - the latter of which is of enormous benefit to clients, particularly when dealing with family assets. Caroline understands the sensitive nature of her speciality areas, and always strives to achieve the best outcomes for her clients with clear, unambiguous advice throughout the process.

Caroline is a member of our Commercial Property and Commercial Departments. With over 20 years' experience in advising clients on a variety of commercial and property matters, Caroline is a key part of several MHP Sellors practice areas, including Banking & Finance; Commercial Contracts/Franchising Distribution Agreements; Commercial Property; Company Formation; Company Secretarial; Corporate Governance & Advisory; Insolvency & Corporate Recovery; Intellectual Property; Mergers & Acquisitions; Partnership Agreements; and Shareholder Disputes. Caroline has acted for a number of private and state lenders and has experience in complex lending transactions. She has also led a number of mergers and acquisitions, drafted shareholder and partnership agreements, advised start-ups, and assisted with state and private equity investments. In addition, she has advised on a number of corporate restructures in both an advisory and transactional capacity. Caroline acts for developers of mixed use commercial and residential developments and also for commercial landlords and tenants in drafting and negotiating commercial leases and variations. She has also acted for a number of primary care centre providers and drafted and negotiated forward funding transaction documentation. Caroline is solution focused and results driven. She is highly experienced in complex commercial matters, and is dedicated to guiding her clients through the process, using plain speaking to explain each step.

Clare Barry

Clare is a member of our Property Department. Having trained with MHP before gaining experience in Galway and Dublin, Clare now plays a key role in several MHP Sellors practice areas, including Probate; Residential Property; and Wills & Estate Planning. Clare has experience in all areas of property transactions (both residential and commercial) including sales, purchases, re-mortgages, and leasing. She has acted on behalf of several local authorities in all aspects of local authority property transactions, as well as commercial lending to charities. For private clients, Clare advises on the drafting of wills, trusts, and the extraction of Grants of Probate. Clare prides herself in forming strong relationships with her clients, and always looks for efficient and practical ways of solving problems while putting her client's interests first.

Derek Walsh

Derek is a Partner in our Litigation and Dispute Resolution Departments. Thanks to his significant experience in all aspects of litigation procedure and practices in all court jurisdictions, Derek plays a key role in several MHP Sellors practice areas, including Commercial Litigation; Dispute Resolution; Clinical Negligence; Defence Litigation; and Licencing and Gaming. Derek advises and acts for and on behalf of a number of insurance companies. He has particular expertise in handling defamation, employer's liability, public liability, occupier's liability, road traffic and property damage claims. Derek also acts for private clients in respect of general litigation matters, in particular those arising out of commercial disputes, shareholder disputes and judicial review matters. In addition, he handles licensing matters for public houses, night clubs, restaurants and casinos. Derek sits on the Board of numerous charitable organisations. He is a Past President of the Limerick Solicitors Bar Association. She also advises on general litigation matters including defamation, landlord and tenant disputes, and debt recovery and also practises conveyancing.

Emma Colleran

Emma is a key member of our Litigation Department and specialises in insurance Defence Litigation. She acts on behalf of insurance companies and self-insured entities in the defence of motor, public liability, employer liability, product liability and defamation claims. She has significant experience at all court levels and has successfully defended many claims including fraudulent claims. She also has experience in handling fatal injury and catastrophic injury claims. Emma also advises on insurance policy disputes and property recovery actions. She has represented clients at arbitration hearings and at mediations. Emma is a member and former treasurer of the Clare Law Association. Emma prides herself on her strong work ethic, attention to detail and unwavering commitment to achieving the best possible outcomes for her clients.

Eugene Cush

Fionnuala is a valuable Consultant Solicitor with over 25 years' experience in providing tax and legal advisory services to private and corporate clients. She is both a qualified solicitor and Chartered Tax Advisor. Having trained with one of the "Big Four" accountancy firms as a Chartered Tax Advisor and obtaining an award for first place in Ireland in her overall grades in her taxation examinations, Fionnuala gained significant experience in all areas of capital taxes. Her dual qualification enables her to advise on a broad spectrum of complex legal and tax transactions. Fionnuala is the former Managing Partner of Keating and Keogh (formerly FB Keating & Company), O'Connell Street, Limerick prior to its merger with MHP Sellors LLP. Helen Rackard

Helen has enjoyed a successful career working in civil litigation at High Court and Circuit Court levels, in the areas of personal injury, chancery, medical negligence, defamation, employment law, public law and insurance law. She acts for several leading insurance companies in policy disputes, property damage recovery claims and fraud claims. While acting for clients in large-scale litigation cases, Helen has negotiated a number of significant settlements with the State and other institutions. A previous Managing Partner of the firm, she also has experience acting for clients in mediation and arbitrations, and has represented clients before many tribunals.

John P Shaw

John P Shaw is a valuable Consultant in Local Authority Law, including planning and environmental matters. He plays a key role in several MHP practice areas, including Commercial Litigation; Environmental & Planning and Public, Regulatory & Administrative Law. John has acted as the County Solicitor for the County of Clare for over 30 years, including judicial review/injunction cases arising mainly from planning and environmental issues. He has also advised the County Council on the adoption of five iterations of the Clare County Development Plan. John has acted in numerous professional negligence claims on behalf of both prosecutor and defence. He has represented many private clients in high-profile actions as well as in the Moriarty Tribunal, the Planning Tribunal and Banking Inquiries. John is a past President of the Law Society of Ireland 2014 and is a member of the Law Society of Northern Ireland. He has served on the Law Society Council for over 20 years, where he chaired the future of the Law Society Task Force and chaired the Complaints Committee of the Law Society for over five years. She possesses considerable experience in general litigation matters including recovery matters, defamation, judicial review and commercial disputes. Kate also plays an important role in the MHP Sellors' Employment Law, Pensions & Benefits team. Handling all aspects of employment law, she advises a broad spectrum of clients in contentious and non-contentious matters. Kate sits on the Board of a local arts centre and has acted as secretary to the Clare Law Association. Marina Keane

Marina has significant experience advising clients across a range of contentious and non-contentious matters, with an emphasis on regulatory law, planning and environmental law and commercial disputes. She is an experienced advocate who represents private, corporate, and public authority clients in all courts. Through her work for local authorities, Marina has gained an in-depth knowledge of public and administrative law, advising on statutory interpretation, regulatory enforcement, public decision making and freedom of information requests. She has handled the defence of numerous judicial review actions challenging planning, environmental and housing decisions and has extensive enforcement experience including criminal prosecutions in the District Court and injunction applications in the Circuit and High Courts. Marina also practices in defence insurance litigation including road traffic, employer's liability, public liability, and product liability cases. In addition, she handles licensing matters for public houses, nightclubs, restaurants, and casinos. Marina previously served as President, Vice President and Secretary of the Clare Law Association and has volunteered with the Free Legal Advice Panel in Ennis. She is highly regarded in the public and administrative law sphere as well as being a leading practitioner in the area of planning and environmental law.

Mary has extensive experience in the preparation of wills, Enduring Powers of Attorney and dealing with the administration of deceased persons' estates and transfer of assets to successors. Mary was a partner in the firm of Nicholas, Nolan Solicitors of Parnell Street, Ennis, a practice that was merged with MHP Sellors in 2022. She has been a member of the Probate Committee of the Law Society.

Landlord and tenant matters, in both residential and commercial properties, is another area of expertise. In addition, Mary advises on the drafting of wills, administration and distribution of estates and Enduring Powers of Attorney. Niall a native of County Limerick, qualified in 1969 starting his legal career in P.S Connolly & Co. (est. 1860's) before in 1978 merging with the practices of M. Sellors & Co. (est. 1800's) and Geraghty & Co. to form, Connolly Sellors Geraghty and making it one of the largest firms in Limerick at this time. Niall has a wealth of knowledge in all Private Client matters, including Property; CPO's; Probate; and Wills and estate planning. A trusted advisor, Niall continues to advise a long list of loyal clients. Niall is a past President of The Limerick Bar Association, Limerick Rotary Club and Old Crescent RFC. Ronan is dual common law qualified, having trained and practiced with a leading UK national law firm. He holds an LLM in International Commercial Law from University of Nottingham and an Executive MBA from Trinity Business School. She has acted for a range of financial institutions throughout her career in all aspects of commercial lending. She advises both commercial and private clients on the options and processes involved in financing their acquisitions. Her role includes advising on landlord and tenant matters for both commercial and private clients which can include but is not limited to the preparation of both long- and short-term Commercial Leases. In addition to her property clients, Sinéad practices in the area of wills and estate planning, administration of estates, Enduring Powers of Attorney and Ward of Court applications. Sinéad is the current Secretary of Clare Law Association, having held the post for over three years. Sinéad Nunan

Sinéad is a Consultant in our Litigation Department. As a highly experienced litigator, she plays a key role in several MHP practice areas, including Alternative Dispute Resolution; Commercial Litigation and Public, Regulatory & Administrative Law. Sinéad deals with all forms of civil litigation including personal injury actions. In addition, she advises local authorities on compulsory purchases and judicial review, while also handling matters of employment and family law as well as procurement. Sinéad is also extremely interested in alternative dispute resolution and is a qualified mediator. She acts as a mediator in a wide variety of disputes, lectures extensively on ADR, and has served on the Arbitration and Mediation Committee of the Law Society of Ireland. A co-author of the book Civil Litigation, published by Oxford University Press, Sinéad is a lecturer and tutor with the Law Society of Ireland. She has also lectured in family law at the University of London. Sinéad is passionate about education, and recently obtained a first class honours Master's Degree in Public Law from NUIG.

As an accomplished and highly experienced commercial solicitor, he is a key part of a wide range of MHP Sellors practice areas, including Commercial Contracts/Franchising Distribution Agreements; Company Formation; Company Secretarial; Data, Privacy & Technology; Insolvency & Corporate Recovery; Intellectual Property; Mergers & Acquisitions; Partnership Agreements; and Shareholder Disputes. Stephen has extensive specialist experience in advising a broad range of companies and public sector bodies across different sectors in high value commercial transactions and complex commercial disputes. He regularly advises Boards of Directors and shareholders on corporate governance matters, directors duties and employment matters. Stephen is a member of the Board of the Charities Regulatory Authority, and was appointed by the Minister for Rural and Community Development. He also sits on the Expert Advisory Panel in Law and Technology at the School of Law, University of Limerick. Previously, Stephen served as President of the Shannon Chamber of Commerce from 2020 to 2022 and as Company Secretary from 2013 to 2018. Stephen brings commitment, energy, drive and innovation to his role as a commercial lawyer.
