Alan J. Ma

Mr. Ma has been in private practice in Honolulu, Hawaii since 1991. Mr. Ma has a diverse practice, including commercial and consumer lending, real estate, general business law and litigation, debt restructuring, loan workouts and bankruptcy. A significant portion of his practice involves representing institutional lenders in commercial loan transactions. Another focus of Mr. Ma's practice involves real estate, including buying, selling, leasing, managing, developing, and financing. He also currently represents lenders in loan restructuring negotiations, foreclosure litigation, and bankruptcy proceedings, and has represented borrowers in such matters in the past. Mr. Ma has been a member of the American Bar Association and the Hawaii State Bar Association since 1991. He has been appointed as a foreclosure commissioner in cases involving commercial property.

Alan K. Lau

Alan K. Lau is a graduate of the University of California, Santa Barbara with a bachelor of arts in Business Economics. He received his law degree from Boston College Law School. Mr. Lau was an editor of the Boston College Law School Uniform Commercial Code Reporter-Digest. Mr. Lau is a founding partner of Tsugawa Lau & Muzzi, LLLC, a law firm specializing in litigation and dispute resolution in the areas of real property, employment law, will, trust and family disputes, commercial and construction disputes. Mr. Lau's practice has been wide spread and emphasized commercial, real estate, employment and family disputes. Mr. Lau also has vast experience with commercial leases. Mr. Lau has participated as an advocate or neutral in numerous mediations and serves as an arbitrator for the Hawaii State Bar Association and the Court Annexed Arbitration Program. Mr. Lau has had extensive training in dispute resolution through the mediation training at the Mediation Center of the Pacific as well as the world renown Pepperdine University Caruso School of Law course on "Mediating the Litigated Case".

Andrew J. Lautenbach

Andrew J. Lautenbach received a BS in Business Administration, Finance, from the University of Colorado at Denver in 2002, and his law degree from the University of San Francisco in 2005. Mr. Lautenbach is a Director at Starn O'Toole Marcus and Fisher, where he has practiced for over fifteen years and has developed a diverse practice that focuses primarily on complex commercial litigation matters. Mr. Lautenbach has vast experience in the mediation and arbitration context, including handling high stakes consumer protection disputes, complex disputes related to construction and development, disputes arising from real estate and other commercial transactions, lender liability matters, disputes related to the control of LLCs, partnerships, and other closely held entities, and disputes related to the management and operation of condominium projects and resorts. Through his work on such matters, Mr. Lautenbach has earned a reputation for finding creative solutions to difficult problems, and for helping parties to efficiently move past counterproductive litigation that could otherwise be devastating to the individual parties and their businesses. ANDREW P. WILSON

Mr. Wilson is married, with four children and five grandchildren, although one would never guess by how he acts and looks that he is old enough to have grandchildren.

BERT KOBAYASHI

Mr. Kobayashi attended the University of Hawaii and graduated from Gettysburg College, with a Bachelor of Arts degree in Political Science with minors in psychology and mathematics and received his Juris Doctor degree from the University of California, Hastings College of the Law. Mr. Kobayashi has served as a party advocate for over 50 commercial mediations and mediated approximately a dozen commercial matters. He has attended the AAA's advanced mediator training series: Expanding the Mediator's Toolbox - Blending Advanced Mediator Strategies.

Bruce McEwan

Bruce McEwan has been mediating for over 30 years and is also experienced in arbitration and facilitation. He brings to mediation his over 40 years of experience as a manager and executive in private industry with extensive knowledge of all areas of insurance, risk management, and employee and labor relations. He served as a corporate Ombuds managing employee relations and workplace conflicts. Dr. McEwan also teaches a course in Conflict Management at the University of Phoenix. Dr. McEwan is a member of the national Association for Conflict Resolution (ACR) and has served in leadership positions in the Hawaii Chapter of ACR. He is also a board member of The Mediation Center of the Pacific and Chair of the Mediation Centers of Hawaii. He also has served in leadership positions for the Society of Chartered Property & Casualty Underwriters (CPCU Society) at the national and local levels. Dr. McEwan holds a Ph.D. in Applied Management from Walden University and M.B.A. from Western New England University. He holds several specialty designations in insurance. CRYSTAL K. ROSE

Ms. Rose graduated from Willamette University, BS in Psychology & Sociology, and University of California, Hasting College of Law and started her legal career at the firm now known as Carlsmith Ball LLC. She is a founding member of the firm now known as Lung, Rose, Voss & Wagnild and concentrates her practice in real estate, construction, trusts and commercial litigation. She has extensive experience representing many clients in mediation, arbitration and litigation. Ms. Rose has expensive experience in real estate/property matters, having representing developers through the various phases of development, design, construction and sale of high-end condominium projects. She has also involved in real estate issues involving acquisitions, title, kuleana claims, ʻiwi kupuna, environmental, mortgage/financing and landlord/tenant disputes. In addition, she has handled claims by buyers, sellers, lenders, realtors as well as amongst development partners. She has also represented developers, architects, engineers, contractors, sub-contractors and suppliers and insurers, as well as individual homeowners, in all aspects of construction litigation, involves delay, construction defects and payment disputes. David H. Franzel

David H. Franzel has arbitrated commercial matters including construction, contract, and cannabis cases and has successfully mediated commercial, real estate, contract, and domestic disputes. As an Owner's Representative, he currently assists clients pursuing renewable energy (wind and solar) projects, telecommunications ground license opportunities, and commercial insurance coverage. In his more than twenty (20) years with the Estate of James Campbell (now James Campbell Company LLC), Mr. Franzel acted as principal client representative and managed and resolved many complex disputes relating to real estate, environmental compliance and remediation, insurance underwriting and claims, mold and water intrusion, subsidence, and construction matters before administrative agencies (State and Federal), lower and appellate courts and well known mediators in Hawaii and on the US mainland. In addition, Mr. Franzel was an integral member of the team which developed and pursued the City of Kapolei concept and that transitioned the Estate of James Campbell into the James Campbell Company LLC, one of the United States' leading real estate companies. He has also practiced real estate, environmental, international trade, and construction law. Mr. Franzel has been a frequent panelist at ACC and ABA meetings, taught seminars on mediation and other alternative dispute resolution methods, and authored "A Model Letter for a Model Mediation" which was published in ALI ABA and ABA publications. An experienced facilitator in the private sector, Mr. Franzel leads strategic planning sessions designed to identify and to capitalize on an organization's opportunities and to address group organizational issues. He also assists private and public groups in avoiding future disputes by utilizing partnering. Mr. Franzel has conducted public policy facilitation sessions for the State of Hawaii on a variety of topics such as energy, housing, smoking, communications, developmental disabilities, tour helicopter noise, and the future of Hawaii's State Judiciary. He assisted the US Commerce Department in its efforts to promote dialogue on fishing rights in the Northwest Hawaiian Islands. Mr. Franzel is an active member of many business and professional organizations and is past Chair of the Hawaii State Bar Association Corporate Counsel section and past Chair of the Mid-Pacific Institute Board of Counselors. DAVID M. LOUIE

David Louie is the former Attorney General of Hawaii, having served a four-year term from January 2011 to December 2014. As Attorney General, he was the chief law enforcement officer for Hawaii. He provided legal services, advice, counsel and litigation representation to the Governor, the Cabinet, the Legislature and various State agencies, boards, commissions and employees. Mr. Louie has been involved in numerous legal issues of importance for both the state and the nation. Mr. Louie graduated from Occidental College (cum laude 1973) and Boalt Hall School of Law at the University of California, Berkeley (1977). From 1977 to 1988, Mr. Louie was an associate and partner at Case & Lynch. From 1988 to 2010, Mr. Louie was the managing partner at Roeca, Louie & Hiraoka. He has concentrated his practice in the areas of civil litigation, insurance defense, construction defect litigation and commercial litigation. He has represented many clients in jury trials, arbitrations and mediations. Mr. Louie has been named a Hawaii Super Lawyer (2008-2011). He served as the President, Vice-President, and Director of the Hawaii State Bar Association (1995-2001) and Vice-President, Secretary-Treasurer, and a Director of the Hawaii Defense Lawyers Association (1993-2010). He was a Lawyer Representative for the United States Court of Appeals (Ninth Circuit)(2005-2008) and Northwest Regional Governor for the National Asian Pacific American Bar Association (2008-2010). He served as a Director (1998-2006) and the Chair (1999-2005) of the State of Hawaii Aloha Tower Development Corporation. He is a member of the Federation of Defense and Corporate Counsel, where he was a past Co-Chair for the Premises Liability Section, and a past Chair of the Diversity Committee. He is a member of the Association of Defense Trial Attorneys, the Defense Research Institute and the American Bar Association. Mr. Louie has been a faculty member and lecturer for numerous continuing legal education seminars for the American Conference Institute, HSBA, FDCC, NAPABA, ABA, Pacific Law Institute, Professional Education Systems, Inc. and the National Business Institute. He has authored a number of published articles regarding trial techniques and legal issues.

Diane Hastert

After 20 years as a commercial litigator, Diane Hastert is convinced there are better ways to resolve disputes, hence her commitment to ADR. She knows mediation and arbitration can save time and money, preserve creative energy, reduce stress and often salvage valuable relationships that have become contentious and unproductive. Experience counts. Creative problem solving to facilitate a mutually satisfactory mediated solution and the ability to be a successful arbitrator depends on it. Mrs. Hastert has represented both plaintiffs and defendants in a wide variety of cases, including complex, multi-party suits. The areas in which she has had substantial experience include construction, aviation, insurance, real estate, bankruptcy, banking and personal injury. Her facility to cut to the chase and provide keen insight and evaluation make her well-suited to assist in the prompt resolution of cases that often are prolonged and tax those involved most severely. Mrs. Hastert began mediating fee disputes between clients and their lawyers for the Hawaii State Bar Association more than 15 years ago. Donna Yoshimoto

Donna Yoshimoto was born and raised in Honolulu, Hawaii and is 1987 graduate of Punahou School and 1994 graduate of the University of Hawaii, William S. Richardson School of Law. Ms. Yoshimoto has represented a broad spectrum of clients in matters ranging from small to large and simple to complex litigation. Her clients are a diverse group including individuals, small businesses, real estate professionals, property managers, design and engineer professionals, construction companies, schools, manufacturers, suppliers, national retailers and insurers. Throughout her career, Ms. Yoshimoto has successfully represented clients in Ms. Yoshimoto has been admitted and qualified to practice in the United States Supreme Court, the United States Court of Appeals for the Ninth Circuit, the United States District Court for the District of Hawaii and all Hawaii State Courts. Ms. Yoshimoto has been selected to serve as a mediator and arbitrator for private-party disputes and is an experienced arbitrator in with the State of Hawaii Court Annexed Arbitration Program.

Erik D. Eike

For the past 36 years, Erik D. Eike, Esq. has represented and fought on behalf of clients in Hawaii's construction industry, including previously serving as General Counsel for Fletcher Pacific Construction & Dick Pacific Construction, as well as representing many other general contractors, subcontractors, owners and design professionals. With his prior professional training in architecture, construction law has been a natural blend of Mr. Eike's architectural and legal training. From licensing, project development, estimating, bidding, contract negotiations, staffing, cost accounting, scheduling, job-site safety, schedule analysis, forensic investigation, government contracting, and collection, Mr. Eike has extensive experience in all aspects of the issues facing Hawaii's construction industry as well as general commercial disputes. He understands the sometimes differing expectations and concerns between a subcontractor, general contractor, owner and designer. He has been involved in both the business side of construction, as well as forensic litigation, for large projects throughout the Pacific Basin and western United States, including Hawaii, Alaska, California, Arizona, Washington, Guam, Saipan and the Federated States of Micronesia. Having handled hundreds of cases in the arbitration and mediation context, Mr. Eike understands the importance of cost effective and efficient alternative dispute resolution so that the parties can resolve their issues and get back to focusing on new business success. As an arbitrator, he brings detailed knowledge not only as to construction and general commercial law, but first-hand experience with industry customs and practices, and the technical aspects of construction including construction cost accounting, safety standards, and schedule analysis. Contracts are important, and must be properly applied in the context of the realities of the job, industry custom, and the practices of the parties. While arbitration should be less formal than court proceedings, and better focused at simply getting to the truth rather than unnecessary procedural hurdles, Mr. Eike believes in a well-run and disciplined hearing with proper decorum and due regard to the importance of the issues at stake. As a mediator, Mr. Eike understands the realities of the construction and business environment, and has observed and learned first hand the most effective mediation techniques from the best in the field in many of Hawaii's largest and most complex cases. Mediation should not be a "numbers" game, but rather, an exploration of the issues, risks, arguments and ultimate outcome prospects for purposes of reaching a mutually acceptable (if not entirely satisfactory) result for which adequate business justification exists. Ultimately, a compromise on dollars will inevitably come into play to reach a mutually acceptable outcome, but should be done in the context of the issues to provide a legitimate basis for prudent business decision. Mr. Eike attended the University of Kansas School of Architecture, and later received his Juris Doctor from the University of Kansas School Of Law. He successfully worked and paid his own way through school doing computer programming for businesses in the days before the PC or Mac. He began his legal career at the large Kansas City firm of Watson Ess Marshall & Enggas in a national management- side labor law practice focusing on multi-plant/multi-State strike situations and labor grievance arbitrations. He later accepted a position with the Honolulu firm of Damon Key Char & Bocken, and has been focused on construction law and general commercial litigation ever since. After opening his own office in 1998, he served as General Counsel for one of Hawaii's two largest general contractors for approximately ten years. He is licensed in Hawaii, Alaska and Missouri, and admitted to practice before the United States Supreme Court and the US Court Of Federal Claims. In 2009, he founded and launched Kilimanjaro Rifles as the preeminent American maker of fine hand- made custom hunting rifles, competing directly with the older established European makers. Under his leadership, Kilimanjaro received Sporting Classics magazine's Award Of Excellence in 2011 for creating "the pinnacle of strength, beauty and accuracy" with the observation that "there is always room at the top." Kilimanjaro's rifles have been featured in all of the major hunting journals, and were selected to grace the cover of Sports Afield magazine's annual rifles issue. Needless to say, Mr. Eike is an avid big game and dangerous game hunter who has hunted all over the world. He is also an experienced blue water sailor who has sailed his own boat from California to Hawaii using only the traditional sextant and nautical almanacs for navigation. Mr. Eike's arbitration and mediation services are available at the rate of $3900 per day or $495 per hour. He is available to travel as necessary for proceedings on all of the Hawaiian Islands, the US mainland, and internationally.

Gary M. Yokoyama

Gary M. Yokoyama, Esq. has been a member of the bar since 1978 and is a graduate of the University of California, Berkeley (B.S.). and the William S. Richardson School of Law (J.D.). Mr. Yokoyama has previously served as Vice President & General Counsel at Hawaiian Dredging Construction Company, Inc., Deputy Corporation Counsel to the City and County of Honolulu, and Law Clerk to Chief Justice William S. Richardson. During his many years at Hawaiian Dredging. Mr. Yokoyama handled legal, contract, bonding, licensing and insurance matters. He actively participated in contract and construction financing negotiations, bid reviews, and claim resolution (mediation/arbitration/litigation) on behalf of the company, including design/construction disputes, employment and labor relations disputes, subcontractor and vendor claims, personal injury and insurance coverage claims, and EEOC, OSHA and environmental proceedings. In his capacity as Deputy Corporation Counsel to the City and County of Honolulu, Mr. Yokoyama represented the City in several significant land use and zoning cases, as well as serving as counsel to the Zoning Board of Appeals, Honolulu Police Commission, Liquor Commission. Mr. Yokoyama has also practiced in the area of condominium law, and has represented numerous associations of apartment owners in all types of matters including construction defect litigation, by-law enforcement, and foreclosures. Georgia K. McMillen

Georgia K. McMillen, Esq., is a mediator, arbitrator and neutral specializing in the resolution of disputes throughout the State of Hawai'i. Legal counsel, their clients and other mediators consistently hold her in high regard for her knowledge of the law and subject matter of a case, as well as her ability to listen, keep everyone focused, and assist in building lasting agreements. Jeffrey S. Portnoy

Jeffrey S. Portnoy is a graduate of the Duke University School of Law. He previously served as Chair of Cades Schutte's Litigation Department, and has practiced law as a civil litigator at the firm since 1972. During Mr. Portnoy's legal career, he has gained extensive litigation and ADR background in several areas of substantive law, including insurance, employment, product liability, media, commercial, and professional errors and omissions. He has tried, to verdict, more than twenty-five cases, and has served as an arbitrator and/or mediator in cases ranging from medical malpractice to construction disputes. He has been selected as one of the Best Lawyers in America, has served as a lawyer representative to the Ninth Circuit Judicial Conference, and was Chairman of the United States District Court Advisory (Biden) Committee. He was also selected to serve as a Hawaii State per diem court judge by Chief Justice Moon. Mr. Portnoy has written several articles for legal publications, including Media Law in Hawaii. He has served as a speaker at numerous state and mainland legal seminars in areas ranging from employment law to insurance issues. He presently serves as the Hawaii State representative to the Defense Research Institute. Mr. Hiatt graduated with honors from Harvard University in 1973. He received his J.D. from the University of Hawai'i at Manoa, William S. Richardson School of Law in 1977 under a grant from the University of Hawai'i's East-West Center. During Mr. Hiatt's final year of law school, he attended Harvard Law School and was selected as an editor of the Harvard Environmental Law Review. Kai Wang

Kai Wang is a seasoned transactional lawyer with two decades of experience practicing law in both Hawaii and Asia. As a partner at Carlsmith Ball LLP, Kai's practice focuses on the areas of real estate, land use, hospitality, foreign investment into real estate in Hawaii. She also serves as the Chair of the firm's Greater China Practice Group. She first joined Carlsmith Ball as an associate in 1999 and became a partner in 2006. Keith W. Hunter is the founder, President and CEO of Dispute Prevention & Resolution, Inc. (DPR). Sherry Broder

Sherry Broder has served numerous times as a mediator, arbitrator and hearings officer for counties, state and federal courts and government agencies and private parties. She has been appointed an arbitrator and consultant in international ocean law matters. She has litigated cases in many state courts, federal district and appellate courts in other jurisdictions, U.S. Supreme Court, other countries and International Tribunals. She has handled many complex cases, including class actions with as many as 850,000 class members. She regularly represents Plaintiffs in tort cases and also represents clients in real estate, land development and business transactions and litigation She represents some of the largest and finest hotels and land owners in Hawai`i. She was the Deputy Chief Attorney at the 1978 Constitutional Convention, served as the attorney/legislative analyst for the Honolulu Charter Commission and Maui Charter Commissions and has worked as an attorney for the Office of Hawaiian Affairs in various capacities for four decades. Ms. Broder was the first woman President of the Hawaii State Bar Association and 2016 President of the Federal Bar Association for the District of Hawaii. She was selected Finalist, Trial Lawyer of the Year Award by the Trial Lawyers for Public Justice, 1994, 1995, and 1997, received the 1992 Solo Practitioner of the Year and 2015 Solo and Small Firm Lifetime Achievement Awards from the American Bar Association.
