Ann Marie Noonan

Experience Ms. Noonan focuses on representing and advising municipalities, school committees, and private employers on labor and employments issues including collective bargaining, discipline, and policy development. She advises private and public sector clients on a wide range of labor and employment law topics including collective bargaining, labor relations, discipline and discharge, layoffs and demotions, discrimination, investigations, leaves, wage and hour matters, and severance and release agreements. Ms. Noonan also provides training to public and private sector clients on labor and employment issues including labor relations, collective bargaining, wage and hour laws, employee leaves and accommodations, discrimination, and discipline and discharge. Ms. Noonan has assisted in representing clients before the Massachusetts Department of Labor Relations, the American Arbitration Association, the Massachusetts Joint Labor Management Committee, and the Massachusetts Commission Against Discrimination. Previously, Ms. Noonan served as Director of Labor Relations for a large municipality. In this role she was responsible for developing the overall bargaining strategy for the municipality, advising on employment and labor matters for all municipal departments, including representing the municipality in arbitrations and unfair labor practice proceedings. In addition, she oversaw training of managers and department heads on employment and labor matters. Experience Mr. Costello's practice focuses on management-side labor and employment law and related litigation; and education law, including special education, student discipline and all other school-related matters. He represents school committees, cities, towns, and other public and private employers before arbitrators, administrative agencies, and in State and Federal Court, relative to labor and employment matters. He has appeared before the Massachusetts Department of Labor Relations, Massachusetts Commission Against Discrimination, the Massachusetts Civil Service Commission, and the National Labor Relations Board. He also conducts employee investigations; represents management in collective bargaining negotiations; and advises and counsels public and private clients in all areas of labor and employment law. Previously, Mr. Costello worked at a Boston based labor and employment firm representing both public and private employers. He also previously served as the Director of Labor Relations for an Executive Office within the Commonwealth of Massachusetts, overseeing all labor and employment matters within the Office's Departments. Education Experience Mr. Hillman represents clients including municipalities, school committees, public agencies as well as private employers in labor and employment matters. He has represented employers in disputes in state and federal courts, arbitral forums and agencies including the Department of Labor Relations, the Massachusetts Commission Against Discrimination and Civil Service Commission. Mr. Hillman counsels clients in areas including collective bargaining, employee hiring, discipline and termination as well disability-related matters. Mr. Hillman conducts investigations for employers concerning employee workplace complaints and matters involving employee misconduct. Mr. Hillman represents both public and private sector clients in business-related matters, including review and drafting of vendor contracts, construction-related matters, as well as commercial disputes, land-use and land title matters. Mr. Hillman has also represented shareholders in closely-held corporate disputes as well as providing advice to non-profit corporations over a wide range of employment and business issues. Experience Ms. Micca assists with representing and advising municipalities, school committees and private employers on labor and employment issues, including collective bargaining, wage and hour laws, anti-discrimination measures, employee leaves and accommodations, discipline, and policy implementation. Ms. Micca also assists with advising school committees on issues including special education and student discipline. While in law school, Ms. Micca worked as a student attorney for the Boston College compassionate release and parole clinic where she successfully advocated for the compassionate release of elder state prisoners suffering from terminal illnesses or irreversible physical or cognitive incapacitation. Professional Activities Experience Mr. Foskett has successfully litigated lawsuits involving all types of employment-related disputes, including claims of employment discrimination, wrongful termination, violations of federal and state statutory and constitutional civil rights, violations of the Fair Labor Standards Act and Massachusetts Wage Payment Law, judicial review of administrative and arbitral labor law rulings, stays of arbitration, ERISA discrimination, municipal health insurance, and claims under the Massachusetts Civil Service Law and Contributory Retirement Law. Mr. Foskett also advises municipal clients regarding various issues of municipal law and has served as Town Counsel. Mr. Foskett also handles all aspects of public school law. In addition to employment issues, these matters include student discipline, school bullying and hazing issues, student records, school finance, and MIAA matters. In addition, Mr. Foskett specializes in appellate practice in numerous substantive areas of the law in the Massachusetts Supreme Judicial Court, Massachusetts Appeals Court, United States Supreme Court, and United States Courts of Appeals for the First and the Ninth Circuits. These cases include several significant decisions involving the areas of domestic relations, labor relations, employment, civil rights, municipal law and contracts. Mr. Foskett has participated in several continuing legal education panels on appellate practice. The clients he has worked for include a wide range of governmental bodies at the state and local level, school districts, for-profit corporations, non-profit corporations, and individuals. Mr. Foskett also advises employers and employees in matters involving executive compensation, severance, non-competition covenants, and non-disclosure agreements. She also works with school clients on issues including bullying, student discipline, special education and student civil rights. Previously, Mr. McKenna represented and counseled a large primarily public sector union and its bargaining unit employees in all labor and employment matters, including collective bargaining negotiations, contract grievance hearings, and hearings before arbitrators and before various state and federal agencies. Experience Ms. Valerio has extensive experience representing cities, towns, school committees, local government agencies, and private employers in negotiations with their employee unions. She has represented management in both traditional and interest-based bargaining with unions representing police, fire, dispatch and other public safety personnel, employees of public works departments, custodians, clerical employees, teachers, administrators, and paraprofessionals. Ms. Valerio advises employers regarding various labor and employment matters and on policy development and implementation. She reviews, revises, and drafts employee evaluation instruments, handbooks, and personnel manuals. Ms. Valerio regularly trains management personnel on subjects including collective bargaining, civil service law, social media, unlawful discrimination and harassment, and employee issues such as hiring, evaluation, discipline, and discharge. As a former school committee chairperson, Ms. Valerio is very familiar with the many challenges facing today's schools. She regularly trains new school committee members throughout Massachusetts on collective bargaining for the Massachusetts Association of School Committees. She also works with school committees and school administrators in reviewing and drafting policies and student handbooks, and she advises school clients on student issues including discipline, accommodations, and bullying.
