Jerry L. Malone practices law and provides consulting, government relations and public policy services in Washington, DC and Little Rock, AR. Mr. Malone's practice is primarily focused on transportation (all modes), infrastructure development and financing (including TIFIA, P3s,SIBs, GARVEES, etc.), WRAPS a/k/a OCIPs a/k/a CIPS (Owner Controlled Insurance Programs or Controlled Insurance Programs), water and power, crisis management/resolution, banking and financial services, education and other government relations needs. From a consulting standpoint, Mr. Malone recently served as Chief Operating Officer of Toyota Motor North America's Quality and Safety Advisory Panel ("Transportation Safety Panel") to render advice to Toyota's leadership both in North America and Japan regarding quality and safety best practices. Malone's service as COO of Toyota's Transportation Safety Panel allowed him to use his keen knowledge of the U.S. Department of Transportation, along with the practical, regulatory and legal implications of safety being the Department's top priority, to lead and guide the Panel's multi-faceted day-to-day operations as the Panel interfaced with Toyota officials, government regulators (especially those with the National Highway Traffic Safety Administration ("NHTSA")), safety advocates representing differing components of the safety community (IIHS, Consumers Union, etc.), U.S. Congressional oversight members and staff.
Malone is a transportation professional who has helped to shape public policy. He has a clear understanding of how public policy and its attendant regulatory considerations impact a company's bottom line. He understands the role that transportation plays in fostering a strong and vibrant economy that produces jobs for growth, competitiveness and prosperity.
In other areas of his practice, Mr. Malone also offers advice regarding the benefits of using Controlled Insurance Programs (CIPs) as a mechanism to achieve significant dollar savings while achieving better safety outcomes, elimination of dueling lawsuits and leveling the playing field for small, minority, women and locally-owned construction firms vying to participate in such infrastructure projects.
Prior to returning to private practice, Mr. Malone served almost six (6) years as General Counsel to the Chief Financial Officer for the Government of the District of Columbia. In this capacity, Mr. Malone counseled and advised the District's CFO on all legal matters such as municipal finance, baseball stadium financing and construction, state and local governmental operations, congressional appropriations, revenue, accounting, budgeting, auditing, income and real property tax administration, lottery and charitable games, bonding and contracting.
Before serving as General Counsel to the DC CFO, Mr. Malone served in the federal government as an appointee in a previous Presidential Administration. Initially, Mr. Malone was appointed Chief Counsel of the U. S. Federal Highway Administration to serve as the chief legal advisor to the Federal Highway Administrator. Upon the Highway Administrator's appointment as U.S. Secretary of Transportation, Mr. Malone first served as Deputy Chief of Staff of the U.S. Department of Transportation and later became the Chief of Staff of the Cabinet-level agency (which at the time had an annual budget in the range of $60 billion and over 100,000 employees).
Before joining the U.S. Department of Transportation, Mr. Malone practiced law for over 13 years at the Little Rock law firm of Friday, Eldredge and Clark-the largest law firm in the state of Arkansas-as a law clerk, associate attorney and partner. In these capacities, Mr. Malone was a commercial litigator representing clients such as Union Pacific Railroad (formerly Missouri Pacific Railroad), Sears, the Federal Deposit Insurance Corporation, the Resolution Trust Corporation, the Arkansas State Highway and Transportation Department, First National Bank, First Commercial Bank, the Little Rock School District, construction companies, insurance and bonding companies (i.e. Fireman's Fund, St. Paul Fire and Marine, etc.) and the like.
Mr. Malone has vast experience working with the U.S. Congress and executive branch agencies of the federal government to either solve problems that already exist or to prevent problems that could otherwise arise. Mr. Malone's practice on the House side focuses primarily on the Transportation and Infrastructure Committee, Oversight and Government Reform, Natural Resources, Judiciary, Homeland Security and Financial Services. On the Senate side, Mr. Malone focuses primarily on Agriculture, Appropriations (Transportation subcommittee), Commerce/Transportation, and Environment/Public Works. In the executive branch, Mr. Malone has broad knowledge of the workings of the U.S. Department of Transportation and the U.S. Department of Homeland Security (including FEMA, USCG, Aviation Security, etc.). He is licensed to practice law in the state of Arkansas as well as in Washington, DC and is admitted to U. S. Federal District Court in D.C. and Arkansas, the 8th Circuit Court of Appeals and the U.S. Supreme Court.

Mr. Clyburn previously served as senior counsel to U.S. Senator Zell Miller. He devised strategies for securing Airport Improvement Program (AIP) appropriations for airports, interfaced with the Department of Homeland Security to address improving the efficiency of airport security lines, and promoted the provision of state-of-the-art in-line explosive detection systems for Hartsfield-Jackson Atlanta International Airport. He advised the Senator on major infrastructure development projects, as well as energy, transportation, telecommunications, and other commerce issues. At the time of his appointment, Mr. Clyburn had served as the Commerce Counsel to U.S. Senator Charles S. Robb of Virginia, where he was responsible for advising the Senator on education policy, science and technology initiatives, chemical manufacturing, electricity deregulation, federal preemption proposals and Senate Commerce Committee issues such as consumer affairs, telecommunications, and tort reform.
President William J. Clinton appointed William Clyburn, Jr. on December 18, 1998, to the U.S. Surface Transportation Board (formerly the Interstate Commerce Commission), a bipartisan, federal agency charged primarily with the economic regulation of the railroad industry. Mr. Clyburn was confirmed unanimously by the United States Senate and served until December 31, 2001. The Commissioner has experience in all three branches of government and has spent over 20 years in Washington, D.C. He has developed an extensive bipartisan network among Members and senior staff within the U.S. Senate and U.S. House of Representatives, as well senior staff in executive branch offices. He also has strong ties to various state and local-elected officials. Commissioner Clyburn currently serves on the board of directors of the HSC Foundation, which is dedicated to improving access to health services for underserved groups living with disabilities and chronic illness, and the National Caucus & Center on Black Aged, Inc. (NCBA), a non-profit organization focused on enhancing the quality of life for low-income elderly.
Prior to joining Senator Robb's personal staff, he was the surface transportation staff counsel with the U.S. Senate Committee on Commerce, Science, and Transportation. He organized Senatorial hearings before the Surface Transportation Subcommittee, and advised the Committee Members on technology and transportation legislation.
Before beginning his work on Capitol Hill, Mr. Clyburn was a law clerk for the Honorable Rodney A. Peeples, Circuit Court Judge for the Second and Ninth Circuits, South Carolina. Before attending law school, Mr. Clyburn performed engineering duties at Westinghouse's Savannah River Laboratory (SRL) in Aiken, South Carolina. At SRL, he conducted pioneering research under the instruction of Dr. George Wicks on the feasibility of immobilizing high-level radioactive waste into borosilicate glass matrices.
Mr. Clyburn received his undergraduate degree in Ceramic Engineering from the Georgia Institute of Technology, earned his Juris Doctor from the University of South Carolina, and is a member of the South Carolina Bar. Mr. Clyburn was inducted into Georgia Tech's prestigious Council of Outstanding Young Engineering Alumni in 2003 and has served on the university's External Advisory Board of the School of Materials Science and Engineering.
Mr. Clyburn has taught a college-level course on public speaking, and still manages time to tutor chemistry and mathematics while volunteering as a Science, Technology, Engineering, Mathematics (STEM) mentor to inner-city youth. He has been recognized for his community work and public policy contributions with a "Solid Image Award." Mr. Clyburn and his wife live in the Nation's Capital and enjoy raising their two children.
