Brian Weir-Harden

Brian focuses his practice on civil litigation, white collar criminal defense matters, internal investigations, government investigations, and corporate compliance. Brian's experience includes a wide range of civil, criminal, and quasi-criminal matters, such as antitrust investigations, tax evasion, bank fraud, immigration, foreign corruption, and administrative proceedings. He regularly engages with federal agencies such as the Department of Justice, Internal Revenue Service, and Securities & Exchange Commission on behalf of state, national, and international clients. Brian has served on attorney teams for federal monitorships resulting from deferred prosecution agreements in the medical device and telecommunications industries. Brian advises clients on the development and implementation of effective compliance programs for state, national, and international corporations. His corporate compliance experience includes risk assessments, compliance training, review and preparation of policies and procedures, and the implementation of corporate best practices in highly regulated industries. Brian also has experience representing creditors in commercial collections, commercial foreclosures, receiverships, and loan restructuring. Brian received his B.A. with honors in philosophy and psychology from Indiana University in 1998, where he was a Herman B. Wells Scholar and a Richard G. Lugar Minority Scholar. In 2007, he received his J.D. from the Indiana University Mauer School of Law, where he was a member of the Black Law Student Association. In2017, Brian was named and "Up and Coming Lawyer" by The Indiana Lawyer for professional and legal achievements early in his practice. Brian is also a Principal Consultant for Proteus Discovery Group, MBCB's independent eDiscovery services and consulting firm. He was previously a partner at Barnes & Thornburg, LLP. Hamish Cohen

Hamish acts as outside general counsel to businesses in multiple industries. He also competes in Ironman triathlons. Hamish is a founding partner of Mattingly Burke Cohen & Biederman and an experienced counselor. Recognized by his peers as a SuperLawyer, his practice focuses on client counseling and litigation in a wide range of business and personal contexts. His expertise includes business transactions, corporate governance, securities compliance, tax litigation and class actions. Jeffrey Furminger

Jon Mattingly

Jon has a B.S. from Notre Dame and a J.D. from Indiana University. He's an avid fan of the Fighting Irish and the Hurryin' Hoosiers. His daughters attend Dayton and Purdue. Jon regularly represents national, regional, and local financial institutions, manufacturers, premises owners, trucking and logistics companies, and other business entities. He has particular experience representing entities involved in the mortgage lending industry and has investigated and litigated matters involving nearly every type of entity up and down the mortgage lending chain, from originating lenders to warehouse lenders to investors in the secondary market. Jon also has significant experience handling complex civil litigation disputes involving product liability and toxic torts, insurance coverage disputes, and a variety of catastrophic claims involving personal injury, wrongful death, and property damage. In this practice, Jon has represented manufacturers from industries including pharmaceutical, industrial and residential construction materials, and of chemicals and pesticide products. He has defended matters involving an assortment of chemicals/particulates such as asbestos, thimerosal, silica, and other allegedly toxic materials. Jon is also a partner in Proteus Discovery Group, an eDiscovery services and consulting company, and DiscoveryMaster, a software platform for eDiscovery reporting. He was previously a partner at Barnes & Thornburg, LLP.

Kelly Paberzs

Kelly's primary focus is supporting MBCB's litigation and creditors' rights practice groups. She has experience in state and federal courts for all phases of litigation, including discovery, trial, and appeal. She previously handled closings for a title insurance company and worked in electronic medical records retrieval. Kelly obtained her paralegal degree in 1997; she joined MBCB in 2019. She lives in Indianapolis with her husband and three children.

Ray Biederman - CEO

Ray has worked in eDiscovery since 2004. He is also a classically-trained violinist and has conducted youth orchestras in Kokomo and Indianapolis. Ray Biederman is primarily a business attorney representing clients ranging from national non-profits to small family-owned businesses in issues ranging from product liability to shareholder disputes. Ray also has experience working businesses through the sale of the business to infusion of capital through complex financing mechanisms and tax credits. Ray's real passion is in electronic Discovery. Ray is a testifying expert is eDiscovery issues and represents large scale organizations in addressing their eDiscovery, data governance and information management needs in the context of litigation, administrative investigations, and responses to data breaches. For more than 20 years, Ray has worked on every aspect of the eDiscovery process, from data preservation through production. Ray is a Super Lawyer Rising Star in eDiscovery, has been cited in multiple court opinions on eDiscovery issues, and is an adjunct lecturer for eDiscovery at the IUPUI School of Informatics and Computing. Ray also advises government agencies, municipalities, and townships on general governance issues. MBCB's partners have founded two eDiscovery businesses; Ray is Chief Executive Officer of both. Ryan Rieff

Ryan Short

Ryan leads marketing efforts for MBCB and its related entities, Proteus Discovery Group and DiscoveryMaster. Prior to joining the firm, Ryan was a business development leader at Echo Global Logistics, Celadon Logistics, and Probo Medical, operating at the intersection of sales, marketing, operations, and finance. The bulk of Ryan's experience is with scoping, deploying, and implementing technology-enabled services, making MBCB's forward-thinking approach to the practice of law a natural fit. Sean Burke
