Derek A. Simon

Derek Simon has a practice focused on working with Indigenous Peoples in the areas of Aboriginal, Commercial, and Environmental Law. He serves a wide range of clients across Atlantic Canada including Indigenous governments, individuals, businesses, not-for-profit organizations, and financial institutions. Derek advises his clients on various legal issue, including: • Consultation, Negotiations and Litigation related to energy and resource projects, including environmental assessments and impact and benefit agreements; • Treaty Implementation, Self-Government and Title negotiations; • Economic Development and Taxation; and • Governance, Environmental Protection, and Land Management. Kelly L. Greenwood - Chairman

Kelly obtained her Bachelor of Commerce with distinction from Dalhousie University in 1985 and her Bachelor of Laws degree from Osgoode Hall Law School in 1988. She was called to the Nova Scotia Bar in 1989 and has been working as a lawyer in Halifax since that time. Kelly joined Burchells as a partner in 2005, and served for over eight years on its Management Committee. Kelly advises on estate planning and elder law issues including preparation of wills, alter ego and joint partner trusts and testamentary trusts, enduring powers of attorney, and personal care directives. Kelly acts as proctor for many estates, advising personal representatives and beneficiaries on issues arising in connection with the Probate Court requirements and issues relating to the distribution of assets to beneficiaries and to heirs-at-law. Kelly acts as counsel for business organizations of various sizes and provides advice relating to a wide variety of business law matters including shareholder and buy-sell agreements, partnership agreements, leasing, contract negotiation and preparation. Kelly represents and provides advice to limited and unlimited liability companies, professional corporations and societies, and has extensive experience with amalgamations, windups and other corporate reorganizations. Kelly acts for vendors and purchasers on asset and share transactions, including preparation and review of purchase and sale agreements, non-competition and non-solicitation agreements, conveyancing and other supporting documents, along with due diligence investigations and advising on compliance with provincial or federal regulatory regimes. She acts for borrowers and lenders in securing financing transactions, with both real and personal property security. Kelly is a member of the Nova Scotia Barristers' Society, the Society of Trust and Estate Practitioners, the Canadian Bar Association, and the Halifax Estate Planning Council. Kevin Quigley

Kevin serves on the firm's management board, and focuses his practice in civil litigation. A native of Riverview, New Brunswick, Kevin attended Mount Allison University and the University of New Brunswick, graduating from the latter with a B.A. in 1984 and an LL.B. in 1987. He articled with what was then Burchell MacAdam and Hayman, joining the firm as an associate upon his admission to the Nova Scotia bar in 1988 and becoming a partner in 1995. Kevin's practice focuses largely on defending clients of some of the largest and best known general liability insurers. Kevin has worked with insurers defending claims relating to manufacturers and product liability, business interruption, property damage, occupiers' liability and motor vehicle losses. Tiffany Cheverie is Legal Counsel with Burchells LLP. She joined the firm in 2009 as a summer law student. Tiffany holds a BA (St. Thomas University), an LLB (Dalhousie University) and a Certificate in Negotiation and Conflict Resolution (Dalhousie College of Continuing Education). She practices in the areas of administrative law, insurance law and property law. Tiffany is keenly interested in the alternative dispute resolution process. Tiffany has participated in numerous mediations and settlement conferences for clients.
